En esta obra se afronta la temática de la responsabilidad objetiva derivada de las actividades peligrosas desde una perspectiva histórico-dogmática. En la primera parte se demuestra que en el Derecho Romano existieron supuesto de responsabilidad sin culpa, fundada en la creación de peligros extraordinarios. Luego se explica el surgimiento de la moderna teoría de las actividades peligrosas y los diversos argumentos que se han propuesto para justificarla. Y en la tercera parte de analiza la cuestión en el subsistema jurídico latinoamericano, para constatar una mayor tendencia de este subsistema a establecer supuestos de responsabilidad objetiva. Se propone, finalmente, una relectura en clave romanista de algunas normas del Código Civil colombiano a partir de las cuales de podría construir una regla de responsabilidad sin culpa para los daños derivados de las actividades peligrosas. Con este trabajo se contribuye a la construcción de un diálogo entre las reglas romanas de responsabilidad sin culpa y la moderna problemática de las actividades peligrosas, pues la comprensión de aquellas resulta de enorme utilidad para cimentar una teoría coherente en esta materia.
