Book excerpt: As climate change threatens to open the Northwest Passage to ice-free travel, Canadian sovereignty over the Arctic has come to the fore. Although Canada’s claim to the Arctic archipelago is now firmly entrenched in the minds of Canadians, less than a century ago, that claim was much less secure. Acts of Occupation draws on a wealth of previously untapped archival sources to piece together the engrossing story of how one explorer’s self-serving ambition ultimately led Canada to craft and defend a decisive Arctic policy. Historians Cavell and Noakes show how unfounded paranoia about Danish designs on the north, fueled by a deliberate campaign of deceit and fear-mongering, was the catalyst for Canada’s active administrative occupation of the Arctic. A compelling tale, Acts of Occupation throws new light on a transformative period in the history of Canadian Arctic policy and provides much-needed historical context for contemporary debates on northern sovereignty.

Available in PDF, EPUB and Kindle. Book excerpt: Fifty years after the adoption of the Declaration on Permanent Sovereignty over Natural Resources by the General Assembly of the United Nations in December 1962, this volume assesses the evolution of the principle of permanent sovereignty over natural resources into a principle of customary international law as well as related developments. International environmental and human rights law leave unresolved questions regarding the limitations of this principle, e.g. extraterritorial and international influences such as the applicable criminal and tort law, as well as the extraterritorial and international promotion of good governance, including transparency obligations.

Available in PDF, EPUB and Kindle. Book excerpt: In this book, author Otto Spijkers describes how moral values determined the founding of the United Nations Organization in 1945, and the evolution of its purposes, principles, and policies since then. A detailed examination of the proceedings of the UN Conference on International Organization in San Francisco demonstrates that the drafting of the UN Charter was significantly influenced by global moral values, i.e. globally-shared beliefs distinguishing right from wrong, good from bad, and the current from a preferable state-of-the-world. A common desire - to eradicate war, poverty, inhuman treatment, and to halt the exploitation of peoples - has led to an affirmation of the values of peace and security, social progress and development, human dignity, and the self-determination of all peoples. All these values ended up in the UN Charter. The book further analyzes how the UN, and especially its General Assembly, has continued to influence the maturing of global morality through contributions to the values debate, and to the translation of these values into the language of international law, including the law on the use of force, sustainable development, human rights, and the right to self-determination. Available in PDF, EPUB and Kindle. Book excerpt: Although customary international law has long been an important source of rights and obligations in international relations, there has been extensive debate in recent years about whether this body of law is equipped to address complex modern problems such as climate change, international terrorism, and global financial instability. In addition, there is growing uncertainty about how, precisely, international and domestic courts should identify rules of customary international law. Custom's Future seeks to address this uncertainty by providing a better understanding of how customary international law has developed over time, the way in which it is applied in practice, and the challenges that it faces going forward. Reflecting an interdisciplinary mix of historical, empirical, economic, philosophical, and doctrinal analysis, and containing chapters by leading international law experts, it will be of use to lawyers, judges, and researchers alike.

Book excerpt: International human rights adjudicators, while facing urgent cases, have used provisional measures in order to prevent irreparable harm, e.g. to order States to halt an expulsion, the execution of a death sentence, destruction of the natural habitat, or to ensure access to health care in detention or protection against death threats. In the practice of the various adjudicators the traditional concept of provisional measures has undergone a process of humanisation. This book addresses the question how such provisional measures can be made as persuasive as possible. Apart from the Inter-American Court, none of the human rights adjudicators motivate or publish their provisional measures. Yet this book analyses their (best) practices and obstacles, determines the underlying rationale for their use of provisional measures and establishes the core of the concept of provisional measures that all adjudicators have in common. It argues that clarity on what belongs to the core of the concept, and on what does not belong to the concept at all, enhances the persuasive force of provisional measures. The practices of the international adjudicators made accessible in this book may prove useful in the ongoing cross-fertilization occurring among these adjudicators. Moreover, the analysis provided allows individual victims, their counsel, NGOs as well as international institutions to address more effectively urgent human rights cases. About this book: 'Rieter's book is a very worthwhile and sorely needed reference. Overall, the book provides a comprehensive and organized explanation of provisional measures and the bodies that may issue them. Its most important contribution is found in the middle chapters addressing the various situations and kinds of harm previously addressed by human rights tribunals when granting provisional measures, although the practical suggestions to human rights tribunals are also surely welcome. Researchers, human rights defenders and the tribunals themselves will find much in Rieter's volume to strengthen and enrich their work. Ideally, the information it contains will contribute not only to better understanding of provisional measures, but also to coherence in, and progressive development of, this area of the law.' Book excerpt: The purpose of these volumes is to examine, explain and appraise contributions made by the United Nations system to international law and the law-creating process. The work assesses the effect UN institutions have had on the law-making process, and the extent to which that law has been accepted by and evidenced in contemporary state practice. It is divided into three main parts. The first examines the practical as well as conceptual aspects of the UN system as a source of law. The second part deals with different fields of activity which have become the subjects of legal rules and processes. Areas covered include human rights, use of force and economic relations. In addition, topics that have not previously been examined in such a comprehensive manner, such as shipping, aviation, and private international law, are also discussed. The third part covers the internal law of the UN system - international civil services and financial contributions.
