Divided into two parts, it deals with both the practice of mediation and the law surrounding mediation. Touching on the theory and philosophy behind the practice, it further describes in a theoretical and practical sense the difference between the emerging models of mediation. Mediator qualities are discussed in terms of issues of gender, culture and power. This book examines the important issue of mediation ethics and, taking into account the developing law surrounding the practice, proposes a code of ethics. It looks at the future of mediation in light of the decline in litigation, the rise in regulatory constraints on mediation and the popularity of online mediation. Mediation Law and Practice provides students and practitioners with the complete text on the practice and law surrounding mediation.

Book excerpt: In 2011, Professor Adrian J Bradbrook retired from a distinguished scholarly career spanning over forty years. During this time, he made a significant contribution to teaching and scholarship not only in property law — specifically to leasehold tenancies law and easements and restrictive covenants — but also to energy law, especially the emerging and growing field of solar energy. This book brings together those people who worked closely with Bradbrook, each an expert in their own right, to honour a career by critically engaging with the contributions Bradbrook made to property and energy law. Each author has chosen a topic that both fits with their own cutting-edge research and explores the related contributions made by Bradbrook. Most unusually, this collection ranges widely across property law, energy law and human rights.

This comprehensive work is edited by distinguished housing expert Susan J. Smith, together with Marja Elsinga, Ong Seow Eng, Lorna Fox O'Mahony and Susan Wachter, and a multi-disciplinary editorial team of 20 world-class scholars in all. Working at the cutting edge of their subject, liaising with an expert editorial advisory board, and engaging with policy-makers and professionals, the editors have worked for almost five years to secure the quality, reach, relevance and coherence of this work. A broad and inclusive table of contents signals (or tesitifes to) detailed investigation of historical and theoretical material as well as in-depth analysis of current issues. This seven-volume set contains over 500 entries, listed alphabetically, but grouped into seven thematic sections including methods and approaches; economics and finance; environments; home and homelessness; institutions; policy; and welfare and well-being. Housing professionals, both academics and practitioners, will find The International Encyclopedia of Housing and Home useful for teaching, discovery, and research needs. International in scope, engaging with trends in every world region The editorial board and contributors are drawn from a wide constituency, collating expertise from academics, policy makers, professionals and practitioners, and from every key center for housing research Every entry stands alone on its merits and is accessed alphabetically, yet each is fully cross-referenced, and attached to one of seven thematic categories whose ‘wholes' far exceed the sum of their parts

This book was released on 2014-07-01 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: 'Protected tenants' are tenants living in premises which are covered by the provisions of the Landlord and Tenant (Amendment) Act 1948 ('1948 Act'). While most residential tenancies in New South Wales are now regulated by the Residential Tenancies Act 2010 ('2010 Act'), the 1948 Act may apply for: * tenancies which commenced before 1 January 1986; in* premises that were built before 16 December 1954 (and, if converted into units, the conversion was before 1 January 1969); where* a 5A lease has not been registered. The rights and obligations of parties under the 1948 Act are significantly different from those in the 2010 Act, particularly in the areas of rent-setting, evictions and repairs. Protected tenants are generally vulnerable occupants, due to their age or disability. This vulnerability, combined with issues involving potential profits from decontrolling premises and the complexity of the 1948 Act, makes this area of advice and advocacy very challenging for tenancy workers. This Guide aims to assist in identifying protected tenancies, to introduce tenancy workers to the issues for protected tenants and to support initial general advice. Further casework should always be undertaken with the support of expert legal advice. Individuals and service providers should not rely solely on the general information in this guide.
