The statistics are established by the European Commission, based on the data transmitted by the EU Member States administrations, in accordance with the EU’s relevant customs legislation. Until December 2013, Council Regulation (EC) No 1383/2003 laid down the provisions for customs actions to enforce intellectual property rights and the implementing legislation, Commission Regulation No 1891/2004, provided specifically for the submission by Member States of information on the detentions made. The present annual statistics provide useful information to support the analysis of IPR infringements in the EU and the development of appropriate counter-measures by customs. Such figures allow for a better understanding of the scope and extent of the problem, which has become a global phenomenon.

Each detention is referred to as a 'case'; a case may involve one or more articles and each case may contain articles of different product categories, belonging to different right-holders. In COPIS (an EU-wide anti-counterfeit and anti-piracy information system containing all applications for action and all detentions), Member States register each case per category of goods and per right-holder. For each right-holder, a new detention procedure will be initiated, which explains why there are more procedures than cases. Certain statistics, e.g. on results, product category, or a given IP right, are provided per procedure instead of per case, as the figure can differ per procedure. Other statistics remain per infringement case, e.g. customs procedures or transport mode, as the figure is only relevant per detention case. The statistics are established by the Commission, based on the data transmitted by Member State administrations, in accordance with the relevant EU customs legislation. From 1 January 2014, Regulation (EU) No 608/2013 lays down the provisions concerning customs enforcement of IPR, including provisions for submitting relevant information by Member States to the Commission. The annual statistics provide useful information to support the analysis of IPR infringements in the EU and the development of appropriate counter-measures by customs. Such figures allow for a better understanding of the scope and extent of the problem.

Book excerpt: This study offers unique up-to-date analysis of the impact on global trade of counterfeit and pirated products, known as "fakes" by the general public. Using statistical analysis and drawing on a global dataset covering almost half million customs data on seizures, the study estimates the huge share of international trade commandeered by counterfeit and pirated goods. In 2013, international trade in such products represented up to 2.5% of world trade, or as much as USD 461 billion. This is the equivalent of the GDP of Austria, or the combined GDP of Ireland and the Czech Republic. Above all, it highlights that right holders, governments and the formal economy as a whole suffer from significant economic and social losses. It also gives an idea about the potential financial revenues collected by criminal networks that are behind such trade.^More specifically, counterfeit and pirated products amounted to up to 5 % of imports in 2013 in the European Union, or as much as EUR 85 billion (USD 116 billion). This suggests that the relative impact of counterfeiting is twice as high for a group of developed countries, such as the EU, than it is for the world as a whole. The scope of the phenomenon appears to be greater than a decade ago. Back in 2008, a previous OECD study estimated that counterfeit and pirated goods accounted for up to 1.9 % of world imports, or up to USD 200 billion, relying on the best data and more limited methods available at that time. In the context of today's revival of international trade in the global economy, there is no shortage of opportunities for counterfeiters and criminals. Counterfeit and pirated trade is a major threat to any modern, knowledge-based economy. Counterfeiting and piracy matter in an innovation driven global economy.^Intellectual property (IP) is a key value generator for firms, helping them succeed in competitive markets. At the macroeconomic level, IP protection and enforcement is one of the main drivers of innovation, which contributes to long term economic growth. Given the fundamental economic importance of IP, counterfeiting and piracy must be directly targeted as a threat to sustainable IP-based business models.

In 2013, following the mandate to its European Observatory on Infringements of Intellectual Property Rights (the Observatory), the EUIPO made the ACIST database available to all law enforcement authorities in every EU Member State, thus launching the 'ACIST community'. The database, which from June 2019 was integrated into the IP Enforcement Portal, gathers statistics on detentions of goods that are suspected of infringing IP rights and converts the collected data into a harmonised format so that they can be compared and aggregated. The report on the EU enforcement of intellectual property rights: results at EU borders and in Member States 2013-2017 is the first joint analysis of two sources of data, namely, detentions at EU borders and within national markets. This first issue on detentions of counterfeit and pirated goods is planned to be updated and published regularly. The report was produced by the EUIPO following analysis of the data on detentions at EU borders reported and published in the IP Enforcement Portal by customs authorities via DG TAXUD, and on detentions within their national markets by 24 of the 28 Member State enforcement authorities. The objective of the report is to inform EU enforcers and policymakers of the trends and estimates of the counterfeit and pirated goods detained, and to develop an evidence base for future policies and priorities. At the time of preparing this report, the figures for detentions at EU borders were available for 100 % of the Member States for the period reviewed. However, the data for detentions within their national markets were not available for every Member State or for every year analysed. In some cases, none of the Member State enforcement authorities had shared their data with the ACIST community, while others had not provided full datasets. Limitations in the availability of data on national market detentions may affect in part the results obtained, in particular at national level.
