[He] observed that the prevalence of impunity in Guatemala has a number of causes, the main ones being a variety of structural factors and the violence to which justice professionals are subjected. Despite the efforts that have been made, urgent reforms are needed. In the first place, a unified justice policy has to be established. Currently, there are many different institutions acting in a fragmentary and disjointed manner, which has a negative impact on the work of the justice system as a whole. It is particularly necessary to define a State criminal and criminological policy. The establishment of a Ministry of Justice could help to solve these problems. At the same time, it is necessary to regulate the way in which justice officials are elected. The existing system is open to external interference and is highly politicized, and this has a negative impact on the independence of the judiciary ... The criminal investigative bodies should coordinate and harmonize their actions so as to guarantee their effectiveness ... Finally, it is necessary to adopt a set of legislative reforms, including in respect of access to justice. The legislature has a basic responsibility to step up the effort to combat impunity in Guatemala."--Summary.
