Book Synopsis Civil Juries and the Politics of Reform by : Stephen Daniels
Download or read book Civil Juries and the Politics of Reform written by Stephen Daniels and published by Northwestern University Press. This book was released on 1995 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Stephen Daniels and Joanne Martin have analyzed patterns in jury verdicts in a number of substantive legal areas, including medical malpractice, products liability, and punitive damages, against the background of the larger political and academic debate over tort reform. Civil Juries and the Politics of Reform brings together and summarizes the authors' extensive empirical research on civil jury verdicts in the context of that debate. Some commentators are arguing that there is a substantial gap between the image of juries and civil justice that is driving tort reform and what is known of the reality of the civil justice system. The authors use their discussion of juries not simply to help inform the policy debate but to analyze tort reform as a public policy issue for what it tells about the policy process itself.

Book Synopsis Improving Breast Imaging Quality Standards by : National Research Council
Download or read book Improving Breast Imaging Quality Standards written by National Research Council and published by National Academies Press. This book was released on 2005-09-27 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mammography is an important tool for detecting breast cancer at an early stage. When coupled with appropriate treatment, early detection can reduce breast cancer mortality. At the request of Congress, the Food and Drug Administration (FDA) commissioned a study to examine the current practice of mammography and breast cancer detection, with a focus on the FDA's oversight via the Mammography Quality Standards Act (MQSA), to identify areas in need of improvement. Enacted in 1993, MQSA provides a general framework for ensuring national quality standards in facilities performing screening mammography, requires that each mammography facility be accredited and certified, and mandates that facilities will undergo annual inspections. This book recommends strategies for achieving continued progress in assuring mammography quality, including changes to MQSA regulation, as well as approaches that do not fall within the purview of MQSA. Specifically, this book provides recommendations aimed at improving mammography interpretation; revising MQSA regulations, inspections, and enforcement; ensuring an adequate workforce for breast cancer screening and diagnosis; and improving breast imaging quality beyond mammography.
Book Synopsis Understanding Health Care Reform by : Arthur M. Feldman, MD, PhD
Download or read book Understanding Health Care Reform written by Arthur M. Feldman, MD, PhD and published by CRC Press. This book was released on 2011-12-14 with total page 225 pages. Available in PDF, EPUB and Kindle. Book excerpt: After nearly a year of debate, in March 2010, Congress passed and the president signed the Patient Protection and Affordable Care Act to reform the U.S. health care system. The most significant social legislation since the civil rights legislation and the creation of Medicare and Medicaid, the bill’s passage has been met with great controversy. Political pundits, politicians, health care economists, and policy analysts have filled the airwaves and the lay press with their opinions, but little has been heard from those who have the most invested in health care delivery reform—patients and their doctors. Understanding Health Care Reform: Bridging the Gap Between Myth and Reality provides readers with the information to make informed decisions and to help counter the bias of political pundits and the influence of the for-profit health care industry. The author introduces readers to a group of dedicated doctors, administrators, and patients whose experiences illustrate the strengths and weaknesses of the health care reform legislation. He also shares his own experiences as both a physician and a patient. The book puts the health care reform legislation in perspective by exploring ten critical areas: The private insurance industry Medicare and Medicaid The elimination of waste caused by overutilization, high administrative fees, and fraud Disease prevention and wellness programs Care for the underserved—the health care "safety net" Quality of care The impending workforce shortage Comparative-effectiveness research to compare treatments Changes in the way medicine is practiced Tort reform Describing the reform act as the foundation and framing of a house, it outlines what doctors, patients, and families must focus on as states, the federal government, and the courts craft this legislation over time. The author cuts through the political rhetoric to address the core question: how do we preserve our ability to provide the best possible care for patients and fulfill our societal mission of providing care for our citizens independent of their financial means? Focusing on strengths and weaknesses, rather than what is right or wrong, he encourages readers to think creatively about their role in establishing a better system of health care in America.

Book Synopsis The Law and Economics of Public Health by : Frank A. Sloan
Download or read book The Law and Economics of Public Health written by Frank A. Sloan and published by Now Publishers Inc. This book was released on 2007 with total page 174 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law and Economics of Public Health synthesizes the empirical research findings on the relationship between law and the public's health that are found scattered in different literature ranging from economic journals to medical journals, journals on addictive behaviors, law reviews, and books. This is the only study to date that has assembled the empirical evidence from many areas ranging from motor vehicle liability and dram shop liability to medical malpractice, products liability as it applies to pharmaceutical products, and medical devices. The Law and Economics of Public Health addresses the fundamental question as to whether or not and the extent to which imposing tort liability on potential injurers improves the public's health. Does the threat of litigation on potential injurers make them exercise more caution? Does insurance coverage counter incentives to be careful? Does the tort system operate as perfectly as the theory would have it? This monograph answers these questions on the basis of empirical evidence. The Law and Economics of Public Health discusses both theory and empirical evidence in several areas of personal injury to which tort liability has been applied. The monograph starts by describing the general law and economics framework used to assess both positive and normative issues relating to tort liability. It then presents the rationale for and empirical evidence on particular applications of tort liability as it applies to personal injury.
