Book excerpt: In 2000, Governor George Ryan of Illinois, a Republican and a supporter of the death penalty, declared a moratorium on executions in his state. In 2003 he commuted the death sentences of all Illinois prisoners on death row. Ryan contended that the application of the death penalty in Illinois had been arbitrary and unfair, and he ignited a new round of debate over the appropriateness of execution. Nationwide surveys indicate that the number of Americans who favor the death penalty is declining. As the struggle over capital punishment rages on, twelve states and the District of Columbia have taken bold measures to eliminate the practice. This landmark study is the first to examine the history and motivations of those jurisdictions that abolished capital punishment and have resisted the move to reinstate death penalty statutes.

Book excerpt: The issue of capital punishment is a continually-debated issue because it calls into question the values and direction of society. How is a civilisation supposed to handle lawbreakers? Are some crimes so heinous and some people so dangerous that the death penalty is the only appropriate response? The United States Constitution prohibits 'cruel and unusual punishment', but opinions on whether that includes capital punishment are vehement on both sides. Many states have some form of death penalty, and public opinion seems to indicate support of it in principle. However, many firestorms have erupted recently over the application of the penalty, including the topics of its use on minors and those with mental disabilities. There are also questions raised about how much of a factor race plays in a capital sentence. Internationally, several countries have foresworn the death penalty, with certain countries in Europe and the Americas refusing to extradite criminal suspects (including suspected terrorists) to the US if capital punishment is a possible sentence. With such politically flammable and ethically challenging issues hanging over it, capital punishment is a vitally important issue to understand. To help facilitate that study, this book assembles a carefully selected and substantial listing of literature focussing on the death penalty. Anyone researching this area of criminal justice will find this book an important tool as it offers easy access to the most relevant works about capital punishment. Following the bibliography, further access is provided with author, title, and subject indexes.

Available in PDF, EPUB and Kindle. Book excerpt: A critical, theoretical, and empirical examination of life imprisonment without the possibility of parole (LWOP) is long overdue. This book presents a unique case study of the 'normalization' of LWOP. More specifically, it explores the ties between LWOP's normalization and death penalty abolitionism, using California as a case study. Drawing on rich empirical research, it brings together relevant literature in criminology, the sociology of punishment, social policy, and sentencing to provide insights into the nature of American penal politics, the role of progressive pressure groups, and the relationship between life imprisonment and capital punishment. This study investigates the extent to which members of civil society who challenge capital punishment (lawyers, non-profit organizations, and lobbyists) have helped normalize LWOP by fostering the belief that it is humane and merciful. The monograph focuses on three domains where anti-death penalty activists have lobbied, campaigned, pled for, and agreed to LWOP; Congress, the political sphere, and courtrooms. For each domain, the book teases out the motivations of the main actors and agencies involved. It analyses the constraints under which they considered themselves to be operating, and the relationship between these motivations and the broad social, legal, and political environment in which they unfolded. Particular attention is paid to actors' understandings of the concepts of 'life' and 'death' in punishment.
