Available in PDF, EPUB and Kindle. Book excerpt: Terrorism law and legal practice has been politically and socially controversial to a degree beyond almost any other legal issue during the past few years, and this analytical text contains extensive analysis of these controversies. Terrorism and the Law offers a thoughtful and up-to-date discussion of all the key materials on terrorism law. It provides comprehensive coverage of all the major domestic, European, and international laws, and their impact on the UK. It also contains an extensive examination of the implementation of these terrorism laws, and of the practical issues they raise. The book contains three Parts. Part I focuses on meanings of 'terrorism' in law and political science. It provides the reader with an understanding of the phenomenon and the legal concept, including its statutory definitions, which is essential to the book's assessment of the strategies and tactics adopted in the codes of laws. It also covers normative constraints, such as human rights. Part II focuses on the United Kingdom law. It provides extensive coverage of the major UK terrorism legislation, such as: the Terrorism Act 2000; the Anti-Terrorism, Crime and Security Act 2001; the Prevention of Terrorism Act 2005; the Terrorism Act 2006; the Terrorism (Northern Ireland) Act 2006; the Justice and Security (Northern Ireland) Act 2007; and the Counter-Terrorism Act 2008. It also examines the key laws and rules relating to terrorism policing and legal processes. It discusses the meaning of these legislative materials, as well as their implementation, and includes reference to case law and practice statements from the police and courts. Part III reflects the impact of European, international and transnational laws and practices, covering international transnational cooperation and extradition, key European Union law measures against terrorism, other international law measures against terrorist activities, and international human rights and terrorism.

This book was released on 2011-01-26 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: The review considered six key counter-terrorism and security powers: (1) the detention of terrorist suspects before charge; (2) section 44 stop and search powers and the use of terrorism legislation in relation to photography; (3) the use of the Regulation of Investigatory Powers Act 2000 (RIPA) by local authorities and access to communications data more generally; (4) measures to deal with organisations that promote hatred or violence; (5) extending the use of 'Deportation with Assurances' in a manner that is consistent with our legal and human rights obligations; (6) control orders (including alternatives). The review concludes that some counter-terrorism and security powers are neither proportionate nor necessary. The key findings are: (i) a return to 14 days as the standard maximum pre-charge detention period; (ii) an end to the indiscriminate use of stop and search powers under section 44; (iii) the end to the use of the most intrusive RIPA powers by local authorities to investigate low level offences and applications by authorities to use RIPA techniques need a magistrate's approval; (iv) a commitment to rationalise the legal bases by which communications data can be acquired; (v) a stronger effort to deport foreign nationals involved in terrorist activities in this country fully respecting our human rights obligations; (vi) the end of control orders and their replacement with a fairer and more focused regime. Additional resources will be provided to the police and security agencies to ensure the new measures are effective not only in protecting the public but in facilitating prosecution.

Book excerpt: Edited by curator Masimilliano Gioni, this book focuses in particular on Koons' art as seen in relation to contemporary American culture. With his aesthetics of plenitude and his pop-up dreams of social mobility and acceptance, throughout his career Koons has composed a "fantasy America [...] custom-made from art and schmaltz and emotions" -to use Warhol's description of his own interpretation of American culture. Through the inclusion of source materials, personal recollections and biographical narratives, the book reads each of Koons' celebrated series through the prism of his biography and the ways in which his individual history intersects with that of his country and culture. Ranging from his upbringing in rural Pennsylvania to his fascination for popular culture and vernacular art, the publication composes an unconventional view of Jeff Koons and his work, retracing the personal influences and cultural histories that have shaped Koons's unique formal vocabulary. Published to accompany the major exhibition in Doha in March 2021, the catalogue features an interview with Jeff Koons by the curator, and essays by the well-known art critic Dodie Kazanjian and the Qatari-American writer and artist Sophia Al Maria.

Book excerpt: Mrs L complained about the care that her father, the late Mr M, received at a Wakefield Metropolitan District Council-funded care home, Hazel Garth and from a visiting community nurse funded by NHS Wakefield District Primary Care Trust. Mr M was visited by the nurse on 13 October 2009 to deal with a problem with a catheter. Later that day he became unwell and was taken to hospital, where he was treated for urinary sepsis as well as a grade 4 necrotic (dead tissue) pressure ulcer on his sacrum. He was treated with antibiotics and recovered somewhat, but he died on 23 November 2009. Mrs L was not satisfied with the responses to her complaints to the Council and the Trust, and complained to the Ombudsmen. Their investigations find service failure by both Council and Trust for the care provided in the home and by the nurse. They also found failings in record keeping at the home and maladministration by both Council and Trust in dealing with Mrs L's complaints. The Council and the Trust's successor (Wakefield Clinical Commissioning Group) are instructed, within three months: to write to Mrs L apologising for the service failures and distress caused by the maladministration; to compensate her for the poor complaint handling; and to prepare action plans that describe what they have done to ensure they have learnt the lessons from the failings identified and what they have done or plan to do to avoid a recurrence.

This book was released on 2008-03-26 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: This joint report from the Health Service Ombudsman and the Local Government Ombudsman investigates complaints made by Mr & Mrs Taylor against Buckinghamshire County Council and Oxfordshire & Buckinghamshire Mental Health Partnership Trust. The complaints concern the care provided to their son, Frank, an adult with severe learning disabilities, from June 2001 to September 2003. Frank has no speech; cannot bathe, shave or dress himself; needs assistance to go to the toilet; needs to wear incontinence pads at night or for any lengthy periods spent outdoors. He needs one-to-one attention for 95 per cent of his waking time. The Council took over responsibility for the operation and management of the home in July 2002. In the care home his care needs were never properly assessed, and a number of significant failings in the level of care were identified. Complaints to both organisations were dealt with slowly, and there was confusion about which body should address the separate aspect of the complaints. Frank was removed from the care home, and kept and cared for at home for three months with no external support. The Ombudsmen, acting jointly under the Regulatory Reform (Collaboration etc between Ombudsmen) Order 2007, investigated. They find maladministration causing injustice and anxiety and distress to Frank and his parents. The conditions and care within the care home were unacceptable, and the Council failed to recognise that when taking over management responsibility. Frank's human rights may also have been infringed. The Ombudsmen recommend a payment of £32,000 as remedy for the injustice and distress caused.
