Available in PDF, EPUB and Kindle. Book excerpt: On November 11, 1919, the citizens of Centralia, Washington, gathered to watch former servicemen, local Boy Scouts, and other community groups march in the Armstice Day parade. When the marchers swung past the meeting hall of the Industrial Workers of the World, a group of veterans broke ranks, charged the hall, and were met by gunshots. Before the day was over, four of the marchers were dead and one of the Wobblies had been lynched by the mob. Through a wealth of newly available primary source material including previously sealed court documents, FBI records released under the Freedom of Information Act, and interviews with surviving witnesses, Tom Copeland has pieced together the events of that day and has traced the fate of the men who were accused and convicted of murdering the marchers. Copeland focuses on Elmer Smith, the local attorney who advised the Wobblies that they had the right to defend their hall against an anticipated attack. Although he never belonged to the IWW, Smith sympathized with their interests, championing the rights of working people, and speaking on their behalf. He was originally arrested with the Wobbles and then took up their cause in the courts, beginning a life-long struggle to free the men who were charged with murdering the Centralia marchers. Copeland recounts Smith’s disbarment and eventual reinstatement, his run for political office, his speeches throughout the Northwest, and his unyielding support for the workers’ cause. This book is a balanced treatment of the Centalia tragedy and its legal repercussions written by a practicing lawyer. It is also a compelling human drama, centering on the marginal life of an industrial frontier labor lawyer, a study of radical politics of the 1920s, and a depiction of conditions of life in the lumber camps and towns. It is thus biography as well as legal, political, and social history.

Available in PDF, EPUB and Kindle. Book excerpt: The McCarthy-era witch hunts marked the culmination of an anticommunist crusade launched after the First World War. With Bolshevism triumphant in Russia and public discontent shaking the United States, conservatives at every level of government and business created a network dedicated to sweeping away the "spider web" of radicalism they saw threatening the nation. In this groundbreaking study, Nick Fischer shines a light on right-wing activities during the interwar period. Conservatives, eager to dispel communism's appeal to the working class, railed against a supposed Soviet-directed conspiracy composed of socialists, trade unions, peace and civil liberties groups, feminists, liberals, aliens, and Jews. Their rhetoric and power made for devastating weapons in their systematic war for control of the country against progressive causes. But, as Fischer shows, the term spider web far more accurately described the anticommunist movement than it did the makeup and operations of international communism. Fischer details how anticommunist myths and propaganda influenced mainstream politics in America, and how its ongoing efforts paved the way for the McCarthyite Fifties--and augured the conservative backlash that would one day transform American politics.

Available in PDF, EPUB and Kindle. Book excerpt: Anita Whitney was a child of wealth and privilege who became a vocal leftist early in the twentieth century, supporting radical labor groups such as the Wobblies and helping to organize the Communist Labor Party. In 1919 she was arrested and charged with violating California's recently passed laws banning any speech or activity intended to change the American political and economic systems. The story of the Supreme Court case that grew out of Whitney's conviction, told in full in this book, is also the story of how Americans came to enjoy the most liberal speech laws in the world. In clear and engaging language, noted legal scholar Philippa Strum traces the fateful interactions of Whitney, a descendant of Mayflower Pilgrims; Supreme Court Justice Louis D. Brandeis, a brilliant son of immigrants; the teeming immigrant neighborhoods and left wing labor politics of the early twentieth century; and the lessons some Harvard Law School professors took from World War I–era restrictions on speech. Though the Supreme Court upheld Whitney's conviction, it included an opinion by Justice Brandeis—joined by Justice Oliver Wendell Holmes, Jr.—that led to a decisive change in the way the Court understood First Amendment free speech protections. Speaking Freely takes us into the discussions behind this dramatic change, as Holmes, Brandeis, Judge Learned Hand, and Harvard Law professors Zechariah Chafee and Felix Frankfurter debate the extent of the First Amendment and the important role of free speech in a democratic society. In Brandeis's opinion, we see this debate distilled in a statement of the value of free speech and the harm that its suppression does to a democracy, along with reflections on the importance of freedom from government control for the founders and the drafters of the First Amendment. Through Whitney v. California and its legacy, Speaking Freely shows how the American approach to speech, differing as it does that of every other country, reflects the nation's unique history. Nothing less than a primer in the history of free speech rights in the US, the book offers a sobering and timely lesson as fear once more raises the specter of repression.
