Protecting the individual freedom of religion without infringing on the rights of others or on legitimate political authority requires delicate balance. The most important of these criteria requires government neutrality and equality before the law. The United States has historically struggled with providing this balance, particularly through Supreme Court decisions, resulting in the passage of the Religious Freedom Restoration Act (RFRA). Application of Locke’s criteria for balancing religious liberty and government authority to three recent cases—a government employee, an employer, and a small business owner—reveal that RFRA legislation threatens this balance by undermining neutral government action and treats citizens unequally before the law.

Conservative and postliberal champions of the freedom of religion often ignore this point, sometimes even arguing that orthodox Christianity was, or should be, at the root of democratic liberty. Everyone Orthodox to Themselves, John Colman’s close study of the religious views and political theologies of John Locke, Benjamin Franklin, James Madison, and Thomas Jefferson, shows otherwise. Colman demonstrates that Locke and his three American students specifically took aim at the idea of orthodoxy, which they argued continuously tempted its believers to try to impose an artificial uniformity upon the religious diversity that naturally exists in society and thought it necessary to advance a more rational, nondogmatic Christianity given the threat they saw religious orthodoxy posed to a free, liberal society. Toleration and Understanding in Locke argues that these works are unified by a concern to promote the cause of religious toleration. Making extensive use of Locke's neglected replies to Proast, Nicholas Jolley shows how Locke draws on his epistemological principles to criticize religious persecution - for Locke, since revelation is an object of belief, not knowledge, coercion by the state in religious matters is not morally justified.
