Available in PDF, EPUB and Kindle. Book excerpt: Key messages Despite the promising benefits that reduce emissions from deforestation and forest degradation, and foster conservation, sustainable management of forests, and enhancement of forest carbon stocks (REDD+) offers through incentives to conserve forests and/or change behavior, it also risks excluding women, exacerbating gender inequalities and restricting women's access to decision-making and benefit-distribution processes.Efforts to mainstream gender in REDD+ in Indonesia are underway. But these remain scattered, fragmented and concentrated at the national level. The Ministry of Environment and Forestry (MoEF) with support from the Ministry of Women's Empowerment and Child Protection (MWECP) have a pivotal role to play in providing a clear and accessible platform for streamlining these initiatives, and building on synergies with ongoing efforts in other sectors.Lessons from CIFOR's assessment of existing efforts to mainstream gender in REDD+ and review of broader research on gender and forests, point to the importance of focusing on both national and subnational levels. A balance must be made between promoting gender equality at all levels whilst designing and implementing measures that are flexible and reflect local-level realities.Recommendations for promoting gender equality in REDD+ include: mainstreaming gender across REDD+ agencies; fostering gender equitable participation in free prior and informed consent; and developing gender-inclusive action plans that are evidence based and developed in consultation with key stakeholders.

The centre plank of these reforms was the establishment of the Administrative Appeals Tribunal with follow-on reforms relating to the Ombudsman, judicial review and freedom of information legislation. The impact of these reforms has been vast and significant. This 2007 book seeks to take stock of the growth and development of administrative law principles. Particular attention is paid to the important cases and key doctrines which provide the theoretical underpinnings of these principles. In this book a team of highly respected administrative law scholars and jurists aim to provide a lucid exposition of the relevant case law, principles and doctrines. The book should illuminate the fundamental features of Australian administrative law and should prove useful to students and practitioners interested in this field.

Available in PDF, EPUB and Kindle. Book excerpt: Cybersecurity Key Legal Considerations for the Aviation and Space Sectors Federico Bergamasco, Roberto Cassar, Rada Popova & Benjamyn I. Scott As the aviation and space sectors become ever more connected to cyberspace and reliant on related technology, they become more vulnerable to potential cyberattacks. As a result, cybersecurity is a growing concern that all stakeholders in both sectors must consider. In this forward-looking book, which is the first comprehensive analysis of the relevant facets of cybersecurity in the aviation and space sectors, the authors explore the vast spectrum of relevant international and European Union (EU) law, with specific attention to associated risks, existing legal provisions and the potential development of new rules. Beginning with an overview of the different types of malicious cyber operations, the book proceeds to set the terminological landscape relevant to its core theme. It takes a top-down approach by first analysing general international and EU law related to cybersecurity, then moving to the more specific aspects of the aviation and space sectors, including telecommunications. Finally, the salient features of these analyses are combined with the practical realities in the relevant industries, giving due regard to legal and regulatory initiatives, industry standards and best practices. The broad range of issues and topics covered includes the following and more: whether the various facets of the international law on conflict apply in cyberspace and to cyberattacks; substantial policy and regulatory developments taking place at the EU level, including the activities of its relevant institutions, bodies and entities; jurisdiction and attributability issues relevant to cybersecurity in the aviation and space sectors; vulnerability of space systems, including large constellations, to malicious cyber activities and electromagnetic interference; various challenges for critical infrastructure resulting from, e.g., its interdependency, cross-border nature, public-private ownership and dual civil-military uses; safety and security in international air transportation, with special attention to the Chicago Convention and its Annexes; aviation liability and compensation in cases of cyberattacks, and insurance coverage against cyber risks; review of malicious relevant actors, malicious cyber operations, the typical life cycle of a cyberattack and industry responses. This book clearly responds to the need to elaborate adequate legal rules for ensuring that the multiple inlets for malicious cyber operations and the management of cybersecurity risks are addressed appropriately. It will be welcomed by all parties involved with aviation and space law and policy, including lawyers, governments, regulators, academics, manufacturers, operators, airports, and international governmental and non-governmental organisations. Review / Testimonial: ”In conclusion, I highly recommend this book for all scholars and practitioners of space and aviation law who need (and we all do!) a highly accurate and comprehensive background to these issues of cybersecurity.” Larry Martinez / German Journal of Air and Space Law (Zeitschrift für Luft- und Weltraumrecht) issue 2, 2021

Which reserve adequacy tools best fit different economies based on their financial maturity, economic flexibility, and market access? What do possible reserve needs in mature markets relate to, and how can their adequacy be assessed? What reserve adequacy considerations hold for countries with limited access to capital markets? How can metrics for these economies be tailored to evaluate their reserve needs? Given the current challenges facing governments and their programs, the oversight provided through auditing is more critical than ever. Government auditing provides the objective analysis and information needed to make the decisions necessary to help create a better future. The professional standards presented in this 2018 revision of Government Auditing Standards (known as the Yellow Book) provide a framework for performing high-quality audit work with competence, integrity, objectivity, and independence to provide accountability and to help improve government operations and services. These standards, commonly referred to as generally accepted government auditing standards (GAGAS), provide the foundation for government auditors to lead by example in the areas of independence, transparency, accountability, and quality through the audit process. This revision contains major changes from, and supersedes, the 2011 revision.

Book excerpt: As we progress into the twenty-first century, Wales is acquiring a new identity and greater legislative autonomy. The National Assembly and the Welsh Government have power to create laws specifically for Wales. In parallel, the judicial system in Wales is acquiring greater autonomy in its ability to hold the Welsh public bodies to account. This book examines the principles involved in challenging the acts and omissions of Welsh authorities through the Administrative Court in Wales. It also examines the legal provisions behind the Administrative Court, the principles of administrative law, and the procedures involved in conducting a judicial review, as well as other Administrative Court cases. Despite extensive literature on public and administrative law, none are written solely from a Welsh perspective: this book examines the ability of the Welsh people to challenge the acts and omissions of Welsh authorities through the Administrative Court in Wales.

Available in PDF, EPUB and Kindle. Book excerpt: We must all make choices about how we want to live. We evaluate our possibilities by relying on historical, moral, personal, political, religious, and scientific modes of evaluations, but the values and reasons that follow from them conflict. Philosophical problems are forced on us when we try to cope with such conflicts. There are reasons for and against all proposed ways of coping with the conflicts, but none of them has been generally accepted by reasonable thinkers. The constructive aim of The Nature of Philosophical Problems is to propose a way of understanding the nature of such philosophical problems, explain why they occur, why they are perennial, and propose a pluralist approach as the most reasonable way of coping with them. This approach is practical, context-dependent, and particular. It follows from it that the recurrence of philosophical problems is not a defect, but a welcome consequence of the richness of our modes of understanding that enlarges the range of possibilities by which we might choose to live. The critical aim of the book is to give reasons against both the absolutist attempt to find an overriding value or principle for resolving philosophical problems and of the relativist claim that reasons unavoidably come to an end and how we want to live is ultimately a matter of personal preference, not of reasons.

Book excerpt: Environmental principles – from the polluter pays and precautionary principles to the principles of integration and sustainability – proliferate in domestic and international legal and policy discourse, reflecting key goals of environmental protection and sustainable development on which there is apparent political consensus. Environmental principles also have a high profile in environmental law, beyond their popularity as policy and political concepts, as ideas that might unify the subject and provide it with conceptual foundations or boost its delivery of environmental outcomes. However, environmental principles are elusive legal concepts. This book deepens the legal understanding of environmental principles in light of recent legal developments. It analyses the increasing legal effects of environmental principles in different jurisdictions and demonstrates how they are shaping and revealing innovative and evolving bodies of environmental law. This analysis is a step forward in understanding a key feature of modern environmental law and presents a robust methodology for dealing with novel legal concepts in the subject. It also makes a contribution to environmental policy debates and discussions internationally that rely heavily on environmental principles, including their supposed legal effects.
