This book was released on 2010-11 with total page 20 pages. Available in PDF, EPUB and Kindle. Book excerpt: Congress passed the Toxic Substances Control Act (TSCA) in 1976, authorizing the EPA to obtain info. on the risks of industrial chemicals and to control those that EPA determines pose an unreasonable risk. However, EPA does not have sufficient chemical assessment info. to determine whether it should establish controls to limit public exposure to many chemicals that may pose substantial health risks. There should be statutory changes to provide EPA with authority to obtain health and safety info. from the chemical industry. This testimony addresses EPA's options for: (1) obtaining info. on the risks posed by chemicals to human health and the environ.; (2) controlling these risks; and (3) publicly disclosing info. provided by chemical co. under TSCA.

Book excerpt: Procedures for Prioritization of Chemicals for Risk Evaluation Under the Toxic Substances Control Act (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Procedures for Prioritization of Chemicals for Risk Evaluation Under the Toxic Substances Control Act (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 As required under section 6(b)(1) of the Toxic Substances Control Act (TSCA), EPA is issuing a final rule that establishes the process and criteria that EPA will use to identify chemical substances as either High-Priority Substances for risk evaluation, or Low-Priority Substances for which risk evaluations are not warranted at the time. The final rule describes the processes for formally initiating the prioritization process on a selected candidate, providing opportunities for public comment, screening the candidate against certain criteria, and proposing and finalizing designations of priority. Prioritization is the initial step in a new process of existing chemical substance review and risk management activity established under TSCA. This book contains: - The complete text of the Procedures for Prioritization of Chemicals for Risk Evaluation Under the Toxic Substances Control Act (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) - A table of contents with the page number of each section

Yet, in mid-2016 the Lautenberg Act regulating toxics - chemicals employed in commerce - was passed, winning business and environmental support. What might explain this? Has the Trump administration undercut the law's effects? Does the Act's passage portend more progressive actions? We show that the Act was a function of the status quo changing due to regulatory efforts abroad and in the United States, and from outside pressures on business. These influences impacted implementation, with the Trump administration not targeting toxics regulation analogous to other programs. Further, the processes we observe for toxics may not be unique.

Book excerpt: Procedures for Chemical Risk Evaluation Under the Amended Toxic Substances Control Act (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Procedures for Chemical Risk Evaluation Under the Amended Toxic Substances Control Act (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 As required under section 6(b)(4) of the Toxic Substances Control Act (TSCA), EPA is issuing a rule that establishes a process for conducting risk evaluations to determine whether a chemical substance presents an unreasonable risk of injury to health or the environment, without consideration of costs or other non-risk factors, including an unreasonable risk to a potentially exposed or susceptible subpopulation, under the conditions of use. This process incorporates the science requirements of the amended statute, including best available science and weight of the scientific evidence. Risk evaluation is the second step, after Prioritization, in a new process of existing chemical substance review and management established under recent amendments to TSCA. This rule identifies the steps of a risk evaluation process including: scope, hazard assessment, exposure assessment, risk characterization, and finally a risk determination. This process will be used for the first ten chemical substances undergoing evaluation from the 2014 update of the TSCA Work Plan for Chemical Assessments (to the maximum extent practicable). Chemical substances designated as High-Priority Substances during the prioritization process and those chemical substances for which EPA has initiated a risk evaluation in response to a manufacturer request, will always be subject to this process. The final rule also includes the required "form and criteria" applicable to such manufacturer requests. Book excerpt: Significant New Use Rules on Certain Chemical Substances - Direct Final Rule (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Significant New Use Rules on Certain Chemical Substances - Direct Final Rule (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 EPA is promulgating significant new use rules (SNURs) under section 5(a)(2) of the Toxic Substances Control Act (TSCA) for 38 chemical substances which were the subject of premanufacture notices (PMNs). One of these chemical substances is also subject to a TSCA section 5(e) consent order issued by EPA. This action requires persons who intend to manufacture, import, or process any of these 38 chemical substances for an activity that is designated as a significant new use by this rule to notify EPA at least 90 days before commencing that activity. The required notification will provide EPA with the opportunity to evaluate the intended use and, if necessary, to prohibit or limit that activity before it occurs.
