Book excerpt: Among the criteria for accession to the European Union are democracy and the Rule of Law. In the insightful analysis offered by the author of this book, these concepts - while admirable and even necessary criteria in principle - are almost impossible to measure, and any judgement grounded in them will always be difficult to justify. In his words, 'by including analysis of democracy and the Rule of Law within the field of the EU enlargement law, the Union entered an unstable terrain of vague causal connections and blurred definitions.' Dr Kochenov addresses this problem by proceeding as follows: 1. Outlining EU enlargement law in general, including the principle of conditionality and the role played by the analysis of democracy and the Rule of Law in enlargement preparation; 2. Focusing on the role actually played by the monitoring of democracy and the Rule of Law in ten candidate countries, scrutinizing the way the EU used the legal tools and competences outlined in its enlargement law. The book adopts the EU's own understanding of democracy and the Rule of Law, as derived directly from the substance of the numerous legal and political instruments issued by the Community Institutions and especially the Commission in the course of the pre-accession process. In this way it demonstrates the actual - as opposed to the officially announced - role played by the assessment of democracy and the Rule of Law in the candidate countries in the regulation of enlargement. Many formidable inconsistencies in the application of the conditionality principle are thus laid bare. This leads the author to a series of recommendations on policy and procedure that he demonstrates could be profitably applied to the regulation of current and future accessions, using the Commission's own structure of monitoring pre-accession reforms in the three areas of the legislature, executive, and judiciary in candidate countries. The probity and soundness of these recommendations, firmly grounded as they are in the actual pre-accession monitoring and its consequences for the pre-accession progress of ten Eastern European countries admitted to the EU in 2004 and 2007, will greatly interest policymakers and scholars concerned with the future of European integration.

Book excerpt: The states from Central and Eastern Europe that joined the EU in 2004 and 2007 provide a fascinating series of case studies for scholars interested in politics, IR and development studies. The interest comes from the fact that never before had so many recipients of EU aid joined the Union and taken on the commitment to become aid donors. The journey from recipients of aid to aid donors is interesting because, not only does it tell us about development policy in CEE states, this policy area gives us an insight into governmental structures in CEE states, foreign policy priorities, public opinion, the role of NGOs/civil society and how well CEE states have taken on board the EU acquis (the EU’s rule book). The book also explores whether the development cooperation programmes of the majority of CEESs reflect the so-called "transition experience" of moving from authoritarianism and socialism to democracy and modern liberalism. It also explores the extent to which these donors are aligned with the approaches of the DAC donors. Finally, by extending the scrutiny to the bottom-up development activities of non-state actors and public opinion, the book will analyse the dynamics of the solidarity of the former ‘East’ with the global ‘South’. This book was published as a special issue of Perspectives on European Politics and Society

Available in PDF, EPUB and Kindle. Book excerpt: Turkey’s accession to the European Union is undoubtedly one of the Union’s most contested potential enlargements. The narrative that dominates the debate surrounding this issue primarily relates to problems such as a lack of respect for fundamental human rights in Turkey, the Kurdish question and the continuing stalemate concerning northern Cyprus. This book looks at these issues, but also proposes that a review of Turkey’s experience with the EU in its numerous incarnations suggests that these concerns may mask a deeper disquiet. Whilst there are several questions that Turkey must address, particularly in the area of human rights guarantees, the concerns which raise debates regarding Turkish membership are not issues that are unique to Turkey. Turkey’s EU experience also raises fundamental questions about religion and the EU project that have greater implication than simply Turkish accession. Through the lens of the Turkish example, this book addresses these broader questions, such as the nature of European ‘identity’, Europe’s Christian past, the limits of pluralism and the fundamental question of religion in the European public sphere. This book will be of great interest to those engaged in research on European law and politics at undergraduate or postgraduate level. It is also aimed at academics with an interest in human rights and the European Union and with a regional interest in Turkey.

The scenarios investigated by the authors include 'triumphant markets', 'turbulent neighbourhoods', 'the hundred flowers', 'shared responsibilities' and 'creative societies'. These are five coherent and thought-provoking images of Europe in 2010. Rather than present a definitive picture of the future of Europe, the authors highlight the range of possible futures, and the factors and actors that are likely to shape them. Written in a narrative style, the scenarios are grounded in a rigorous analysis of the main trends affecting Europe's future, including demography, technology, globalisation and post-modernity.

Although minority protection played a prominent role in the accession of the country to the European Union, hardly any positive minority rights were adopted in post-communist Bulgaria. Apart from the reversal of communist assimilation campaigns, only limited progress has been made in the area of minority protection. Positive minority rights have remained very restricted, some minorities, notably Pomaks and Macedonians, have been denied recognition, and the formal adoption of legislation or policy documents has often not been followed by implementation.By charting minority rights policies in Bulgaria in the period between 1989 and 2004, this study clarifies the main reasons for the limited progress in the post-communist period. While, in contrast to some other countries in Central and Eastern Europe, minority “kin-states” did not play a major role in post-communist Bulgaria, the European Union and the Council of Europe were instrumental in putting minority questions on the agenda of Bulgarian governments. However, their impact was smaller than much of the literature on enlargement and conditionality would suggest. Domestic factors were crucial in shaping minority rights policies in post-communist Bulgaria. Of particular importance was the communist legacy, which acted as a brake on the development of minority rights.

Available in PDF, EPUB and Kindle. Book excerpt: In a historic decision at its Copenhagen Conference in June 1993, the European Union gave the green light to an eastward expansion. Initially, invitations to join the EU went out to just six countries of the former Soviet bloc: Poland, Hungary, the Czech and Slovak republics, Romania, and Bulgaria. However, it was not long before there was a queue of other applicants from Eastern Europe pressing at the EU’s gates. There were real fears in some quarters that the economic reforms demanded for entry into the EU would bring about more ‘shock’ than ‘therapy’ in Eastern Europe, and that a rapid move to the market would undermine support for democracy. This volume of essays, by a group of internationally recognised experts, focuses on the eastward expansion of the European Union and the EU’s relations with the applicant states. The primary aim of the volume is to provide a historical and analytical account of the enlargement process and to provide readers with a scholarly road map to guide them through the intricacies of the rapidly changing enlargement terrain. After region-wide studies of the enlargement process, there are case studies of eight countries: Bulgaria, Romania, the Czech Republic, Slovakia, Croatia, Serbia, Poland, and Estonia.

Book excerpt: Public and Private Participation in the Water and Wastewater Sector provides practical guidance on applying Public Private Partnership structures within the constraints of European legislation, with examples on how to ensure consistency with EU procurement, competition law and the Water Framework Directive. It reconciles the need for adequate regulation within the context of a monopoly provision of service – a major concern of the European competition policy. The purpose of this book is to provide practical guidance on how to introduce a Public Private Partnership (PPP) as a strategy towards helping meet the demands for massive capital investments and improved management and performance in the water and wastewater sector. The introduction of PPPs within a European context needs to be assessed against compliance with basic EU law principles related to Competition and the Water Framework Directive. International legal structures in the management, distribution and treatment of water are discussed. There is a brief overview of the present realities of European integration, the political and legal aspects involved in the water sector and two cases in which a viable solution was reached and which form the basis of this research. The book examines the general principles of EU law in terms of competition and procurement and how other directives have an impact on PPP. It then assesses the specific rules applicable to PPP in the EU context, and their implications in designing water PPPs. The book concludes with a review of two case studies (the City of Sofia, Bulgaria and the City of Tallinn, Estonia) that show how the Public Private Partnership structure chosen provides a sound legal basis and a viable way to achieve compliance with Community law and the Water Framework Directive, thus assisting the process of accession to the EU for each country. Public and Private Participation in the Water and Wastewater Sector: Developing Sustainable Legal Mechanisms is principally aimed at supporting municipal, provincial, and central governments and other policy makers seeking to improve water services. It is a must read for policymakers and practitioners seeking to navigate through the intricacies of EU legislation and the complexities of public private partnerships. The principles addressed in this book will also be useful outside the European context.
