Book excerpt: La regulación de la economía por los poderes públicos no es un fenómeno jurídico nuevo, en cuanto que siempre han existido normas de ordenación e intervenciones administrativas en los sectores más relevantes. Sin embargo, a partir de los años ochenta del siglo pasado se inició, casi simultáneamente en toda Europa, un proceso de privatización de empresas que operaban en sectores económicos esenciales y que con anterioridad eran de titularidad pública. El Estado abandonó rápidamente su posición de gestor de empresas. Al mismo tiempo que su capital pasaba a manos privadas, se adoptaron medidas de liberalización de los indicados sectores económicos, algunos de los cuales organizados antes como monopolios, imponiendo la igualdad de condiciones en el mercado y la competencia entre operadores. La ordenación de la economía liberalizada no se dejó, sin embargo, por completo, a las fuerzas del mercado, sino que se aprobaron normas, habilitaron intervenciones administrativas, se declararon derechos e impusieron obligaciones a las empresas. Estas actuaciones públicas emplearon técnicas e instrumentos no experimentados en nuestra tradición jurídica o reconfiguraron los conocidos para adaptarlos a los nuevos principios de relación del Estado y el mercado. Este conjunto de normas, instrumentos y técnicas de ordenación, supervisión e intervención, se agrupan en la denominada regulación pública de la economía. Sobre su disciplina jurídica se han publicado muchos estudios monográficos en los últimos años, pero era precisa una sistematización y explicación general. Este último es el objetivo de esta obra. Su primer volumen analiza los fundamentos e instituciones esenciales del derecho de la regulación. Los sucesivos estudian las peculiaridades de la regulación en cada uno de los principales sectores de la economía.
