Book excerpt: En la Ley Hipotecaria de 1861 se estableció un sistema registral inmobiliario que en sus grandes líneas ha llegado hasta la actualidad. Encontramos en sus primeras normas trazos anticipados de lo que posteriormente vendrán a consagrarse como principios básicos de nuestro sistema jurídico. No debe de extrañarnos en absoluto: las normas que rigen la organización de los Registros Públicos de bienes tienen en una gran parte, un componente de abstracción. Se trata de preceptos encaminados a regular tanto el procedimiento registral como los efectos que con la publicidad se consiguen y por lo tanto se prestan a la coherencia. Esta coherencia interna facilitó el que se recogieran principios jurídicos que encajan perfectamente en nuestra Constitución actual. Mediante la revisión de las normas hipotecarias desde la perspectiva de nuestra vigente Constitución, puede afirmarse que el sistema registral responde a sus exigencias de seguridad jurídica, a la vez que se manifiesta adecuado para afrontar las nuevas tareas que una sociedad en cambio empieza a plantear. Pero por otro lado, no debe olvidarse que nuestra Constitución establece una compleja distribución de competencias entre el Estado y las Comunidades Autónomas. Es al Estado a quien corresponde en exclusiva la regulación del Registro de la Propiedad, aunque ello sea sin perjuicio de ciertos aspectos de ejecución autonómicos. Por ello, el presente trabajo estudia también el Registro como oficina así como la figura del Registrador. Esta distribución competencial se complica además por la referencias que al Registro se hace en los distintos Estatutos de Autonomía, por ciertas competencias autonómicas que pueden incidir en la oficina registral (el idioma, por ejemplo) y por la regulación sustantiva que de determinadas materias hacen las Autonomías y que necesitan del Registro para que sean verdaderamente eficaces. Especialmente complejo es este tema cuando se tienen además, por ciertas Comunidades Autónomas, competencias en materias de Derecho Civil. Todas estas cuestiones se abordan sobre todo con el estudio y análisis de la jurisprudencia del Tribunal Constitucional.
