Book excerpt: La Responsabilité Sociale de l'Entreprise (RSE) a pris, dans les années 1990, l'envergure d'un véritable phénomène. Les entreprises ont adopté une multitude d'instruments, comme les codes de conduite et chartes éthiques, censés incarner une conscience éthique, sociale et environnementale. Le présent ouvrage tente de saisir toute la complexité de ce phénomène en restituant les résultats d'une recherche collective et d'un colloque qui s'est tenu à Lyon le 12 juin 2009, financés dans le cadre d'un projet ATIP - Jeunes chercheurs du CNRS. Ces travaux se sont attachés à répondre à différentes questions. Quels sont les origines et les développements tant pratiques que théoriques de la RSE ? Comment participent-ils à une nouvelle forme de gouvernance des entreprises ? Comment les instruments de la RSE sont-ils mis en oeuvre ? Comment le système juridique les appréhende-t-il ? L'analyse juridico-institutionnelle de la RSE a semblé insuffisante pour rendre compte de toutes ses dimensions. Une approche pluridisciplinaire a donc été privilégiée face aux limites d'une analyse exclusivement juridique, économique ou sociologique. Des regards croisés " permettent d'appréhender l'objet d'analyse avec autant d'approches que de disciplines et d'auteurs. Les explications et les visions s'entrecroisent. Cette confrontation de regards sur le même objet permet une meilleure compréhension de la RSE. Les contributions ici rassemblées en développent les principaux aspects. Elles s'attachent d'abord à comprendre la genèse, la filiation et les objectifs de la RSE qu'ils soient sociologiques, historiques, économiques, internes ou externes à l'entreprise. Elles proposent ensuite un aperçu de l'encadrement juridique des pratiques de RSE au niveau international et européen, ainsi que de leurs différents prolongements : pratiques effectives des entreprises adhérentes au Pacte mondial des Nations Unies, négociation transnationale d'entreprise, réception des actes de la RSE par les juridictions françaises, recours à des normes techniques de certification ou d'audits, etc. Ainsi le présent ouvrage va-t-il au-delà des définitions usuelles aussi commodes que partielles et éclaire-t-il sous un nouveau jour ce phénomène complexe.
