Available in PDF, EPUB and Kindle. Book excerpt: This book offers a comprehensive and detailed analysis of refugee protection in Southeast Asia from an international law perspective. It examines both the legal and policy frameworks pertaining to the protection of refugees in the region as well as the countries’ response to refugee movements from the Indochinese refugee crisis in the mid-1970s to the most recent developments. It covers important aspects of refugee protection, such as access to territory, non-refoulement, the treatment of refugees, the concept of refugee as applied in the region, burden-sharing and durable solutions to the plight of refugees. The analysis focuses specifically on the main countries of asylum within the Association of Southeast Asian Nations that are not parties to the 1951 Refugee Convention, namely Thailand, Malaysia and Indonesia. Using an international law perspective based on the doctrine of the ‘two elements’ (practice and opinio juris), the author argues that these states have long recognized that people fleeing persecution, armed conflict and generalized violence, namely refugees, should be protected. This in turn demonstrates that they recognize the existence and relevance of the international refugee regime despite their refusal to accede to the Refugee Convention. Offering a different perspective on the links between international refugee law and refugee protection in Southeast Asia, this book will be of interest to researchers and practitioners in the fields of international relations, international refugee law, international human rights law, migration governance and Southeast Asian Studies.

Available in PDF, EPUB and Kindle. Book excerpt: The Rohingya of Myanmar are one of the world’s most persecuted minority populations without citizenship. After the latest exodus from Myanmar in 2017, there are now more than half a million Rohingya in Bangladesh living in camps, often in conditions of abject poverty, malnutrition and without proper access to shelter or work permits. Some of them are now compelled to take to the seas in perilous journeys to the Southeast Asian countries in search of a better life. They are now asked to go back to Myanmar, but without any promise of citizenship or an end to discrimination. This book looks at the Rohingya in the South Asian region, primarily India and Bangladesh. It explores the broader picture of the historical and political dimensions of the Rohingya crisis, and examines subjects of statelessness, human rights and humanitarian protection of these victims of forced migration. Further, it chronicles the actual process of emergence of a stateless community – the transformation of a national group into a stateless existence without basic rights.

Book excerpt: For half a century (ever since the Japanese invasion of 1942), much of Southeast Asia has been racked by war. In the last 20 years alone, some three million people fled their homes in Vietnam, Laos and Cambodia. This book is their story. It is also the story of the international community's response. Spearheading this was the United Nations agency responsible, UNHCR. It pioneered innovations like the Orderly Departure Programme, anti-piracy and rescue-at-sea efforts, and later on, ambitious reintegration projects for returnees. Today the camps in Southeast Asia are closed. Half a million people have returned home. Over two million have started new lives in the United States, Canada, Australia and France. This compelling book is the history of this modern exodus. It also takes stock and poses important questions. How did the flight of refugees and international response evolve? How do we measure the achievements and the failures of that international effort? What has been the legacy in Asia itself? And what lessons can be drawn for use in other refugee situations around the world?

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the current reality and the future of ethnic Rohingyas in Myanmar. It presents Myanmar’s history, ‎policy, politics and, most ‎importantly, while focusing on Rohingya ethnic conflict, presents a resolution by looking at ‎the global and regional policies ‎and politics of South Asia and ‎South-East Asia. The recent coup unfolded in Myanmar and the detention of the democratic ‎leaders has surprised the ‎world with its subsequent emergency declaration in 2021, thus making this ‎book ‎relevant and well-timed. ‎ Eventually, the book offers an account of a previously ‎little ‎known, yet much-discussed role of media, ‎international actors, human trafficking, ‎and ‎humanitarian-based resolution for Rohingya refugee crisis. It shows a new perspective ‎in the post-Rohingya influx era of Bangladesh and the neighbouring countries.

Available in PDF, EPUB and Kindle. Book excerpt: This book critically discusses the multi-dimensional contemporary issues within the ambit of the driving forces, mechanisms, vulnerability, and opportunities of the intra-region human movement in South Asia. It covers different dimensions of cross-border migration within South Asia as well as internal migration particularly in India, reflecting upon both voluntary and forced movements. It traces the trajectory and past trends in migration in the South Asian countries. It evaluates the vulnerability of refugees and stateless vis-à-vis state policies. Issues regarding Rohingya refugees from Myanmar to Bangladesh, Nepalese immigration to India, the crisis around Sri Lankan Tamil refugees, Afghan returnee refugees from Pakistan and Iran, resettlement of Bhutanese refugees are explored in the chapters. It also analyzes the impact on wage inequality due to emigration, the crucial role of social capital in migration decisions, and socio-economic vulnerabilities of women migrants in India. This book provides a clear understanding of international and internal migration in South Asia for students and academics, and a valuable resource for policy-makers and planners in development studies, regional development, and South Asian studies.
