Book excerpt: This work analyzes the management of shared fish stocks; protection of the underwater cultural heritage; the possibilities of establishing marine protected areas and other means for safeguarding vulnerable marine ecosystems; the use of the high seas for intelligence as well as recent developments on interdiction of vessels on the high seas. Special emphasis is paid to the role of international courts and tribunals in the progressive development of the law of the sea as well as the ability of the UN Convention on the Law of the Sea to accommodate new uses and challenges, such as new concerns, new technological possibilities, in particular, new contexts and functions of established rules. The 1982 Convention seems capable of coping with most of them, although it remains useful to explore its possibilities and limits. This work, covering many aspects, will be useful to anyone interested in the law of the sea.

Available in PDF, EPUB and Kindle. Book excerpt: Environmental Ethics in Buddhism presents a logical and thorough examination of the metaphysical and ethical dimensions of early Buddhist literature. The author determines the meaning of nature in the early Buddhist context from general Buddhist teachings on dhamma, paticcasamuppada, samsara and the cosmogony of the Agganna Sutta. Consequently, the author shows that early Buddhism can be understood as an environmental virtue ethics. To illustrate this dimension, the Jatakas are used as a source. These are a collection of over five hundred folk tales, which also belong to early Buddhist literature. This work gives an innovative approach to the subject, which puts forward a distinctly Buddhist environmental ethics that is in harmony with traditional teachings as well as adaptable and flexible in addressing environmental problems.

Book excerpt: '[When] great issues were coming to the fore ... that would determine the future of the mighty Columbia River & the international water relations of those two neighbors, who stand astride most of the North American Continent, Canada & the United States ... Charles Bourne established himself as a preeminent figure in the developing stages of the law.' (from the Biographical Note by Professor Albert E. Utton). One of the drafters of the ILA Helsinki Rules, Professor Charles Bourne is an authority in the field of international water law. He has edited & written widely in respected journals & has served on the noted committees of recognized scholars that have helped shape & interpret the state of the law. This collection compiles a selection of Professor Bourne's definitive articles with a forward by the editor surveying recent developments in the field & an introduction by Professor Lucius Caflisch (Graduate Institute of International Studies, Geneva). Its comprehensive coverage & Professor Bourne's own stature in the law of international water systems make this essential reading for all specialists & students involved with water, & a tribute to a foremost expert in the field. '... the present volume is a must for anyone seriously interested in the law of international waterways. It evidences a constant scholarly preoccupation with almost all aspects of that law. Above all, it reflects standards of conciseness, clarity, elegance & scholarship which rightly are the envy of Professor Bourne's colleagues.' (From the Preface by Professor Lucius Caflisch).

This book was released on 2016-12-24 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: The main main purpose of the book was to counter the rather simplistic view of the discipline of usul al-fiqh that it represents a single uniform theory, called the classical theory. The view presented in this book was that there is no uniform single legal theory in Islam. The view of a uniform theory was held not only by the Orientalists, but many Muslim scholars as well. The view did not do justice to Islamic jurisprudence for it overlooked the rich diversity found in the Islamic legl system. Instead of one, the book shows, there are at least three legal theories, each of which has been explained by the author in some detail and with remarkable lucidity. Each of these theories has played a useful role in the past and each can play even today a vital role in the development of Islamic law. Another purpose was to explain the paradox of the so-called rigidity of Islamic law at the theoretical level accompanied with a perceptible degree of laxity in practice. The author forcefully argued that the Islamic Legal system comprises two cooperating spheres. The first sphere is relatively fixed since it is focused on given texts. This sphere falls within the domain of the jurists. The other sphere, which draws upon the general principles of Islamic law, regulates the law made by the state. These are separate but complementary spheres. Neither is the relative fixity of the first sphere a manifestation of the Muslim jurists' mental rigidity. Nor is the flexibility of the second sphere the manifestation of any cynical disregard of the revealed texts on the part of the rulers. The book has been influential in many other ways, and has given rise to research in several new directions. First published in 1994, it is still used by teachers, researchers, university students and general readers.
