Book excerpt: Since 2007, the Supreme Court of Pakistan has emerged as a dominant force in Pakistani politics through its hyper-active use of judicial review, or the power to overrule Parliament’s laws and the Prime Minister’s acts. This hyper-activism was on display during the Supreme Court’s unilateral disqualification of Prime Minister Yousef Raza Gilani in 2012 under the leadership of Chief Justice Iftikhar Chaudhry. Despite the Supreme Court’s practical adoption of restraint subsequent to the retirement of Chief Justice Chaudhry in 2013, the Court has once again disqualified a prime minister, Nawaz Sharif, due to allegations of corruption in 2017. While many critics have focused on the substance of the Court’s decisions in these cases, sufficient focus is not paid to the amorphous case-selection process of the Supreme Court of Pakistan. In order to compare the relatively unregulated process of case-selection in Pakistan to the more structured processes utilized by the Supreme Courts of the United States’ and India, this book aims to understand the historical roots of judicial review in each country dating back to the colonial era extending through the foundational period of each nation impacting present-day jurisprudence. As a first in its kind, this study comparatively examines these periods of history in order to contextualize a practical prescription to standardize the case-selection process in the Supreme Court of Pakistan in a way that retains the Court’s overall power while limiting its involvement in purely political issues. Book excerpt: Crude oil extraction in the Niger Delta region of Nigeria generates 96% of all foreign earnings and 85% of state revenues, making it crucial to the survival of the Nigerian state. Several generations of state neglect, corruption and mismanagement have ensured that the Delta region is one of the most socio-economically and politically deprived in the country. By the late 1990s there was a frightening proliferation of armed gangs and insurgent groups. Illegal oil bunkering, pipeline vandalism, disruption of oil production activities, riots, and demonstrations intensified and in 2003, insurgents began kidnapping oil workers at a frenetic pace. In late 2005, an uber-insurgent movement 'organization' was formed in Nigeria. Christened the Movement for the Emancipation of the Niger Delta (MEND), it operates as an amorphous, multifaceted amalgam of insurgent groups with an unprecedented clinical precision in execution of intents. By focussing on kidnappings that are putatively connected to the struggle for emancipating the Niger Delta, Oriola makes the case for analysing MEND as a social movement organization, rather than a terrorist or criminal gang by showing how political processes shape kidnappings in the Delta. The use of violent repertoires of contention has not garnered sufficient attention in the social movement literature, despite the fact that that around the world, many similar groups are adopting violent tactics without necessarily eschewing non-violent techniques. The colour-code endures, but now in postcolonial masks. Political freedom notwithstanding, vast sections of the black citizenry have adopted and adapted the code to fit the new reality. This vertiginous reality is manifest in the neo-apartheid ideology of Makwerekwere - the postcolonial colour-code mobilized to distinguish black outsiders from black insiders. Apartheid vertigo ranges from negative sentiments to outright violence against black outsiders, including insults, humiliations, extortions, searches, arrests, detentions, deportations, tortures, rapes, beatings, and killings. Ironically, the victims are not only the outsiders against whom the code is mobilized but also the insiders who mobilize it. Drawing on evidence from interviews, observation, press articles, reports, research monographs, and history, this book unravels the synergies of history, migration, nationalism, black group relations, and violence in South Africa, deconstructing the idea of visible differences between black nationals and black foreign nationals. For liberal democratic theory at least, judicial authority and its institutions have ensured constitutional legality by requiring the legislature and the executive to operate accountably against a higher normative order. This is not a predominant function of judges and courts in the international context despite their statutory invocation to this task . Case-studies of global crime and control reveal contexts in which the co-opted governance of institutional ICJ in particular, has a politicized motivation which too often advances the authority and interests of one world order against the sometimes legitimate resistance of criminalized communities. When the analysis moves to the consideration of victim community interests, and from there to the appropriate global constituencies of ICJ, the nature and limitations of ICJ supporting governance in the risk/security model, becomes apparent.
