The institutional arrangements that define natural resource governance are outcomes of political processes, whereby numerous groups with often-divergent interests negotiate for access to and control over resources. These political processes determine the outcomes of resource governance reform efforts, such as widespread attempts to decentralize or devolve greater tenure over land and resources to local communities. This volume examines the political dynamics of natural resource governance processes through a range of comparative case studies across east and southern Africa. These cases include both local and national settings, and examine issues such as land rights, tourism development, wildlife conservation, participatory forest management, and the impacts of climate change, and are drawn from both academics and field practitioners working across the region. Much political discourse simply proceeds from the idea that humans have rights because they are human without seriously interrogating this notion. Egalitarian Rights Recognition offers an account of how human rights are created and how they may be seen to be legitimate: rights are created through social recognition. By combining readings of 19th Century English philosopher T.H. Green with 20th Century political theorist Hannah Arendt, the author constructs a new theory of the social recognition of rights. He challenges both the standard ‘natural rights’ approach and also the main accounts of the social recognition of rights which tend to portray social recognition as settled norms or established ways of acting. In contrast, Hann puts forward a 10-point account of the dynamic and contingent social recognition of human rights, which emphasises the importance of meaningful socio-economic equality.

While Indonesia is committed at the national and international level to addressing climate change through the forestry sector, there are clearly contextual challenges that need to be addressed to create the enabling conditions for REDD+. Some of the major issues include inconsistent legal frameworks, sectoral focus, unclear tenure, consequences of decentralisation, and weak local governance. Despite these challenges, however, REDD+ opens up an opportunity for improvements in forest governance and, more broadly, in land use governance. More democratic political-economic processes in general, greater freedom of civil society and the press, and heightened awareness of environmental issues can help build support and solidify policies in this direction.

Book excerpt: The Government's policy of empowering people through Community Rights to save local assets from closure, build community housing, take over local authority services and bring public land back into use has in its first two years had mixed results. The Rights - to Bid, to Build, to Challenge and to Reclaim Land - have generated some successes, with a small number of community groups being able, for example, to use the Community Right to Bid to stop valued local assets such as the local pub being sold for redevelopment. But limitations have also been exposed. The Community Right to Build is too complicated; the Community Right to Challenge, which triggers a tendering exercise to run a local service, risks damaging relations between communities and local government and is a gamble for groups wanting to run a local service as they may be outbid; and the Community Right to Reclaim Land has hardly been used. The Committee wants to see the Rights improved so that local people have more say over what happens to the land, buildings and services in their area. The Government should: enhance the Community Right to Bid by increasing from six to nine months the time people have to bid to buy a local asset; make it easier to remove or restrict the "permitted development" exemption from planning control when an asset has been listed as having Community Value; and make an asset's status as an Asset of Community Value a material consideration in all but minor planning applications.
