Book excerpt: Rampant global counterfeiting has led the fashion industry to seek ever greater enforcement of its intellectual property (IP) rights. Yet, as this hugely informative book shows, this is not new. Fashion designers and entrepreneurs, as well as manufacturers and tradespeople in the broader textiles industry from which fashion springs, have always struggled to convert existing IP rules to an industry that was—and is—configured by the pressure of intrinsically fleeting consumer tastes and trends. The distinguished author, adding to the series of major works that have made him a leading authority on IP law, triumphantly reveals in great detail how society has constructed IP in association with textiles so as to accommodate it to the particular characteristics of fashion that emerged in the last century. More than two hundred sources, many of them for the first time available in English, illustrated with fifty figures, allow the reader to directly encounter those who have made and continue to make the IP of textiles and fashion. The underlying raisons d’être of such aspects as the following become brilliantly clear: how fashion designers protect their creations against the spread of knock-offs; how fashion entrepreneurs appropriate prestige and reputation; how an iconic design becomes a brand or acquires secondary meaning; and how such inventions as the sewing machine and the cotton gin affected IP rights in textiles and fashion. Each source is preceded by a note placing it in its social, economic, and legal context. The sources are structured in two chapters (business identifiers—trade and certification marks, geographical indications—and appropriation of knowledge and creativity—patents, designs, copyright, and trade secrets) so as to permit an easy understanding of the enchainment of important moments that have contributed to give IP for textiles and fashion its special configuration, in particular the transition from textile law to fashion law. With this book, listening directly to the voices of those who have made and make IP, academics, students, magistrates, professionals, and the legal community as a whole will have a clear and realistic sense of how the combination of the entrepreneurial spirit with the imperatives of human consumption has designed and continues designing the special scope and limits of IP as applied to textiles and fashion.

Available in PDF, EPUB and Kindle. Book excerpt: Miskimin's work considers the religious feuding, hostility, and occasional cooperation of Catholics, Protestants, and Jews in 17th-century Metz. In a series of pointed chapters, she shows how the French Crown benefited from religious disagreement in the town by using that discord to push through its centralizing political agenda. Despite the disapproval of local leaders and the lack of any ideological commitment to coexistence, Catholics, Protestants, and Jews increasingly developed daily contacts in the city as the century progressed. Though these contacts were often hostile, they nonetheless continued and led to more complex interactions which undercut traditional religious verities. Using numerous examples from local court records, Miskimin explores the multilayered contacts between adherents of these three faiths in one of the only French towns to include this tripartite religious mix during this period. As a result, Metz became a convenient early laboratory for the fundamental intellectual shifts at work in Europe. Building on earlier studies of centralization, this book integrates social and religious history with major political shifts to illustrate the interdependence of members of these three groups, as well as the centrality of their clashes to an understanding of the climate of these turbulent times at the dawn of modernity.

Book excerpt: This book investigates the legal evolution of the “free soil principle” in England, France and the Low Countries during the Early Modern period (ca. 1500–1800), which essentially stated that, as soon as slaves entered a certain country, they would immediately gain their freedom. This book synthesizes the existing literature on the origins and evolution of the principle, adds new insights by drawing on previously undiscussed primary sources on the development of free soil in the Low Countries and employs a pan-Western, European and comparative approach to identify and explain the differences and similarities in the application of this principle in France, England and the Low Countries. Divided into four sections, the book begins with a brief introduction to the subject matter, putting it in its historical context. Slavery is legally defined, using the established international law definition, and both the status of slavery in Europe before the Early Modern Period and the Atlantic slave trade are discussed. Secondly, the book assesses the legal origins of the free soil principle in England, France and the Low Countries during the period 1500–1650 and discusses the legal repercussions of slaves coming to England, France and the Low Countries from other countries, where the institution was legally recognized. Thirdly, it addresses the further development of the free soil principle during the period 1650–1800. In the fourth and last section, the book uses the insights gained to provide a pan-Western, European and comparative perspective on the origins and application of the free soil principle in Western Europe. In this regard, it compares the origins of free soil for the respective countries discussed, as well as its application during the heyday of the Atlantic slave trade. This perspective makes it possible to explain some of the divergences in approaches between the countries examined and represents the first-ever full-scale country comparison on this subject in a book.

Available in PDF, EPUB and Kindle. Book excerpt: In a richly layered and beautifully illustrated narrative, Raymond Jonas tells the fascinating and surprisingly little-known story of the Sacré-Coeur, or Sacred Heart. The highest point in Paris and a celebrated tourist destination, the white-domed basilica of Sacré-Coeur on Montmartre is a key monument both to French Catholicism and to French national identity. Jonas masterfully reconstructs the history of the devotion responsible for the basilica, beginning with the apparition of the Sacred Heart to Marguerite Marie Alacoque in the seventeenth century, through the French Revolution and its aftermath, to the construction of the monumental church that has loomed over Paris since the end of the nineteenth century. Jonas focuses on key moments in the development of the cult: the founding apparition, its invocation during the plague of Marseilles, its adaptation as a royalist symbol during the French Revolution, and its elevation to a central position in Catholic devotional and political life in the crisis surrounding the Franco-Prussian War. He draws on a wealth of archival sources to produce a learned yet accessible narrative that encompasses a remarkable sweep of French politics, history, architecture, and art.
