Book excerpt: In response to a congressional request, GAO provided information on: (1) the Interstate Commerce Commission's (ICC) implementation of the market dominance and rate reasonableness provisions of railroad deregulation legislation; and (2) shippers' ability to obtain rate relief from ICC under the legislation. GAO found that: (1) most of the rate dispute cases were settled through shipper and railroad negotiations; (2) although ICC believed that many shippers obtained rate relief through contract rates, out of 19 cases where ICC ruled that a rate was unreasonable, only 6 cases resulted in a negotiated contract, and only one of the shippers involved believed the contract rate to be rate relief; (3) ICC published coal rate guidelines to help railroads set reasonable rates, help shippers evaluate proposed rates, and encourage negotiated rates; (4) the guidelines contained no practical method for apportioning fixed costs among shippers, which resulted in widely varying methods of calculating upper limits on costs; and (5) recent case decisions have helped clarify what approaches to determine these costs ICC will find acceptable.

GAO examined STB data, conducted interviews, and held an expert panel.

Book excerpt: " The nation's freight rail network is vital to the economy, moving about 40 percent of U.S. freight and generating over $73 billion in revenue in 2013. Railroads charge various rates for moving freight from a particular origin to a particular destination. A rate may be set by the railroad in a public pricing document-known as a tariff-or negotiated through a private contract with a shipper. While most freight ships under contract, some shippers have raised concerns with how railroads negotiate contracts that contain multiple origin-to-destination routes. Though shippers that use rail to transport freight under tariff may seek relief from STB for rates they view as unreasonable, STB has authority to review tariff rates, but not contract rates. The Surface Transportation Board Reauthorization Act of 2015 included a provision for GAO to review rail transportation contract proposals containing multiple origin-to-destination routes. This report addresses (1) similarities and differences in shipping freight under a tariff versus a contract, and the potential benefits to using each, and (2) views of selected stakeholders on the implications of shipping freight under a tariff versus a contract.
