Le vieillissement de la population en France s’est imposé comme un enjeu majeur des politiques publiques. Il impacte de nombreuses institutions confrontées à des difficultés inédites. C’est le cas des établissements pénitentiaires où les personnes détenues âgées de plus de 50 ans représentent 11,9% de la population carcérale au 1er janvier 2018. Loin de chercher à appréhender le vieillissement en prison à partir d’un point de vue en surplomb, le vieillissement est analysé à travers la compréhension des expériences vécues par les personnes détenues et celles des personnels. Comment les personnes détenues âgées éprouvent-elles leur incarcération ? En quoi la présence croissante des personnes âgées en détention change-t-elle les manières de travailler en prison ? Ainsi, ce livre analyse la construction sociale du problème de la vieillesse dans l’environnement de la prison. Il porte sur les désajustements et réajustements d’une institution face à un public nouveau qui vient interroger – et donc révéler – ses modes habituels de fonctionnement. Les images sociales de la vieillesse, associée souvent à une forte vulnérabilité, et celles des détenus, perçus sous le spectre de la dangerosité peinent à s’articuler. Comment dès lors, l’institution prend-elle en charge des personnes détenues âgées qui méritent punition et suscitent compassion ? L’analyse de l’expérience carcérale des personnes détenues âgées et la compréhension des dilemmes moraux vécus par les professionnels questionnent de manière singulière le sens de la peine et ce qu’il est moralement acceptable en matière de droit de punir. Les analyses reposent sur une enquête empirique menée dans quatre prisons où 135 entretiens ont été réalisés dont 63 avec des personnes détenues et 72 avec des personnels.

Avec 1683 détenus de plus de 60 ans, 411 septuagénaires, 27 octogénaires et 3 nonagénaires la population âgée n'est plus une population marginale en prison. Le vieillissement est le fruit d'une double évolution: vieillissement des entrants et allongement des peines. Une étude réalisée au sein des deux centres de détention de Toul et Ecrouves (54), a permis de rencontrer 35 détenus. Les 2/3 étaient incarcérés pour des crimes et délits à caractère sexuel. 71,4% de ces détenus avaient des peines supérieures à10 ans, 25,7 % des peines comprises entre 5 et 10 ans et 1 détenu était condamné à perpétuité. L'évaluation sanitaire de ces détenus, l'étude de leur environnement socio-familial et de la littérature a permis de révéler les problèmes secondaires à l'âge et à la détention. Les détenus âgés rencontrent des problèmes spécifiques à la détention: isolement, vieillissement accéléré, perte de la notion de temps, impact sensoriel, effets psychologiques et maladies psychosomatiques, violences. De même la présence de détenus âgés en prison, le vieillissement, l'existence de pathologies chroniques et dégénératives posent des problèmes aux différents établissements pénitentiaires: handicaps, dépendance soulevant des problèmes d'hygiène, de transferts et de déplacements. Une réflexion sur la fin de vie s'impose également.
