En este sentido, los autores de la presente obra abordan el estudio de diferentes aspectos relacionados con la navegación de recreo y los puertos deportivos, con ocasión de la entrada en vigor de Ley 2/2018, de 28 junio, de puertos y transporte marítimo del País Vasco, proporcionando soluciones a las dudas interpretativas que plantea el marco jurídico actual, e incorporando una visión de lo que ocurre en el ámbito internacional, con especial referencia a Italia y Francia. Con esta publicación se pretende que abogados, académicos, compañías aseguradoras, empresas de chárter náutico, administraciones públicas y demás profesionales del sector marítimo y portuario puedan disponer de una obra de referencia para conocer el régimen jurídico actual de la náutica deportiva o recreativa, así como de la gestión y explotación de los puertos deportivos.

Book excerpt: Desde los años sesenta, la práctica de deportes náuticos no ha dejado de ser considerada una actividad elitista y restringida a los grupos económicos más favorecidos. Sin embargo, el número de personas que se aficionan a la navegación de recreo está aumentando (cifras que constatan este hecho es la existencia de 196.750 barcos deportivos matriculados en el año 1995 frente a los 297.472 registrados a finales de 2004) y con ello la necesidad de disponer de infraestructuras que por sus características inherentes se localizan en ámbitos de gran fragilidad ambiental (los costeros y/o fluviales) y que precisan una gestión adecuada y regularizada. En este contexto, desde los inicios de la práctica náutica en la provincia de Huelva y hasta hace algunas décadas, gran parte de las embarcaciones del litoral onubense han fondeado las aguas libremente. No obstante, las autoridades competentes, en un marco de cooperación administrativa, han advertido la necesidad de establecer una ordenación en las superficies acuáticas. En esta línea de trabajo, las actuaciones quedan ligadas a la aparición de una actividad económica novedosa que permite ofrecer a una demanda incipiente una serie de servicios básicos para sus barcos y la práctica deportiva. Así, la ordenación del nuevo sector genera diversos resultados y supone implicaciones a varias escalas: la económica, la social, la urbana y la ambiental. Para abordar su estudio, el libro se centra en los puertos deportivos del litoral onubense y tiene como objetivo analizar cada una de las instalaciones ubicadas en su línea costera. La estructura de la investigación comienza por un acercamiento a la zona de estudio en la que se asientan las infraestructuras, de tal forma que se obtenga un conocimiento determinado sobre el área que va a verse afectada por los influjos de la práctica náutica. En esta línea, se describen los condicionantes naturales y las unidades ambientales del tramo litoral considerado, así como los principales usos productivos que predominan en los municipios objeto de estudio con la finalidad de comprender su apuesta por los deportes asociados a los medios acuáticos. Dado que uno de los resultados de la aparición de una instalación de tal envergadura, siempre que esté bien planificada, debe ser potenciar un turismo de calidad, el trabajo consta de un cálculo de la carga turística litoral que soportan las playas de la provincia de Hueva en los meses de verano, así como las características de la demanda y la oferta. Igualmente, se contemplan las implicaciones que conlleva el aumento de visitantes en la temporada alta en los municipios afectados. El acercamiento a la dinámica de funcionamiento de los puertos deportivos y otras infraestructuras de carácter náutico se lleva a cabo mediante una somera exposición de la legislación básica vigente y el reparto de competencias en la materia entre los Ayuntamientos, la Comunidad Autónoma y el Estado. Tras establecer el escenario de la investigación se presenta una descripción individual y por cada espacio concreto de las infraestructuras objeto en la que se contempla la situación actual de las mismas. A fin de dilucidar el entramado administrativo que supone la consecución de las concesiones o autorizaciones pertinentes para realizar cualquier actividad en dominio público marítimo-terrestre, se ha considerado conveniente exponer cómo se produce el proceso de otorgamiento que da lugar a la aparición de las construcciones. Igualmente queda patente el régimen de gestión mayoritario en los actuales puertos deportivos y los cambios que se prevén más adelante.

"Sun and fun" destinations like Torremolinos (located in the Costa del Sol) and Benidorm (located in the Costa Blanca) established a model for urban renewal that literally built the coasts to accommodate and expand foreign tourism as the driving force of the so-called Spanish Economic Miracle. In addition to inserting the coasts into the scope of Iberian urban studies (typically dominated by studies of Madrid and Barcelona), this project breaks new ground by bringing to the fore unexplored cultural artifacts vital to the narrative of development along the coasts in Spain—in particular the ubiquitous tourist postcard, which advances not only the post-Franco economic miracle, but does so by highlighting the transformation of the actual Spanish landscape along its coasts. The Paradox of Paradise features more than twenty-five striking images of coastal Spain in the throes of its own coming of age. Author William J. Nichols has unlocked a strange, self-conscious archive that tells us as much about our own age of advertising as it does about the hotels and resorts and people on display.
