Partiendo, pues, del estudio de las singularidades propias de cada tipo de proceso, queremos contribuir a marcar el camino por el que podamos transitar hacia la aprehensión de los elementos esenciales que permitan progresar con destino a la construcción de esa teoría general de la prueba prohibida.El origen y el desarrollo de la prueba prohibida han quedado en manos de los tribunales; la flexibilidad que ello proporcionó, y aun hoy proporciona, ha sido a menudo fuente generadora de inseguridad jurídica. Sin que se prefiera la frescura propia de la jurisprudencia, va siendo hora de sentar las bases para la construcción de la teoría general de la prueba prohibida que pueda trasladarse al ámbito legislativo; el lector podrá comprobar que tal aspiración es objetivo común de la mayoría de los coautores. El reto es de suma dificultad, pero irrenunciable al mismo tiempo.Con este esfuerzo conjunto ve la luz “Procesos y prueba prohibida”, obra que sometemos con gusto a la consideración de la comunidad jurídica abiertos al debate y en la esperanza de contribuir con ella a avanzar en el camino hacia la elaboración de la teoría general de la prueba prohibida.
