Book excerpt: This book provides a framework for comparing EU citizenship and US citizenship as standards of equality. If we wish to understand the legal development of the citizenship of the European Union and its relationship to the nationalities of the member states, it is helpful to examine the history of United States citizenship and, in particular, to elaborate a theory of ‘duplex’ citizenships found in federal orders. In such a citizenship, each person’s citizenship is necessarily ‘layered’ with the citizenship or nationality of a (member) state. The question this book answers is: how does federal citizenship, as a claim to equality, affect the relationship between the (member) state and its national or citizen? Because the book places equality, not allegiance to a sovereign at the center of its analysis of citizenship, it manages to escape traditional analyses of the EU that measure it by the standard of a sovereign state. The text presents a coherent account of the development of EU citizenship and EU civil rights for those who wish to understand their continuing development in the case law of the Court of Justice of the European Union. Scholars and legal practitioners of EU law will find novel insights in this book into how EU citizenship works, in order to be able to grasp the direction in which it will continue to develop. And it may be of great interest to American scholars of law and political science who wish to understand one aspect of how the EU works as a constitutional order, not merely as an order of international law, by comparison to their own history. Jeremy Bierbach is an attorney at Franssen Advocaten in Amsterdam. He holds a Ph.D. in European constitutional law from the University of Amsterdam, the Netherlands.

Available in PDF, EPUB and Kindle. Book excerpt: Popularly, the causes of the American Revolution are considered the Stamp Act and other repressive actions by the Crown against its colonies in the years following the French & Indian War. Some see the sources in the outcome of that war, when George III forbade settlement beyond the Alleghenies. J. Revell Carr takes a longer view, and in Seeds of Discontent, he locates the roots of the Revolution a century earlier. In the latter half of the 17th century, tensions between colonists and the Crown were strikingly similar, culminating in the Revolution of 1689. Though subsequent decades were relatively peaceful, the bitterness was not forgotten, and friction began to build throughout the 1720s and 30s, reaching a peak after the famed 1745 battle for Louisbourg, the seemingly impregnable French fortress in Nova Scotia. Won on England's behalf at great cost to the largely American-born strike force, it was given back to France two years later in return for French concessions in the Caribbean-an act that outraged politicians, citizens, and soldiers alike. Bringing to life the two generations that inspired our Founding Fathers, Revell Carr illuminates an eventful century largely ignored by historians.

Available in PDF, EPUB and Kindle. Book excerpt: The American revolutionaries themselves believed the change from monarchy to republic was the essence of the Revolution. King and People in Provincial Massachusetts explores what monarchy meant to Massachusetts under its second charter and why the momentous change to republican government came about. Richard L. Bushman argues that monarchy entailed more than having a king as head of state: it was an elaborate political culture with implications for social organization as well. Massachusetts, moreover, was entirely loyal to the king and thoroughly imbued with that culture. Why then did the colonies become republican in 1776? The change cannot be attributed to a single thinker such as John Locke or to a strain of political thought such as English country party rhetoric. Instead, it was the result of tensions ingrained in the colonial political system that surfaced with the invasion of parliamentary power into colonial affairs after 1763. The underlying weakness of monarchical government in Massachusetts was the absence of monarchical society -- the intricate web of patronage and dependence that existed in England. But the conflict came from the colonists' conception of rulers as an alien class of exploiters whose interest was the plundering of the colonies. In large part, colonial politics was the effort to restrain official avarice. The author explicates the meaning of "interest" in political discourse to show how that conception was central in the thinking of both the popular party and the British ministry. Management of the interest of royal officials was a problem that continually bedeviled both the colonists and the crown. Conflict was perennial because the colonists and the ministry pursued diverging objectives in regulating colonial officialdom. Ultimately the colonists came to see that safety against exploitation by self-interested rulers would be assured only by republican government.
