They decided to connect their institutions in a formal way by establishing a cooperation that would outlive their mandates as deans and provide a professional platform for legal scholars of both universities to get first-hand insight into a very different legal system, thus widening their legal horizons and inspiring a different view and new solutions for their own national law. This noble endeavour has so far been a great success. What might have seemed an unlikely alliance proved to be an extremely valuable and inspiring experience both on a professional and personal level. The idea of this book was born after a joint conference held in Johannesburg in 2019. Here, experts from both institutions presented current relevant issues in different legal areas and discussed how both countries dealt with them. After insightful debates, it was decided that they should, on the one hand, be written down, and, on the other hand, that the written texts should not only reflect those debates but should broaden and deepen the research. It should not merely be a collection of conference papers, but a true scientific monograph, destined to legal scholars and practitioners, researching, teaching and practicing in national and international environments. Book excerpt: Half a century ago, on 16 December 1966, the UN General Assembly adopted the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR). While the adoption of the two UN human rights covenants was celebrated all over the world, their 50th anniversary has received very little attention from the international community. The present book marks this anniversary by taking stock of the first half-century of the existence of what are probably the world's two most important human rights treaties. It does so by reflecting on what the covenants have achieved (or failed to achieve) in the years that have passed, by determining and comparing their current influence in the various regions of the world, and by assessing their potential roles in the future. The book contains papers that were presented during a symposium held in Zurich in 2016, which brought together experts and stakeholders from a range of disciplines and world regions. Some fundamental issues that are addressed by the contributors are as old as the two covenants themselves. They concern, for example, the division of human rights into first- and second-generation rights, and the question of whether there should be one central monitoring body - possibly a world court - or more than just one. However, the contributors go beyond such questions that have been explored before; they develop new answers to old questions and point to new challenges.

Such violence is considered a systemic, widespread and pervasive human rights violation, experienced largely by women because they are women. Yet at the international level, there is a gap in the legal protection of women from violence. There is currently no binding international convention that explicitly prohibits such violence; or calls for its elimination; or, mandates the criminalisation of all forms of violence against women. This book critically analyses the treatment of violence against women in the United Nations system, and in three regional human rights systems. Each chapter explores the advantages and disadvantages coming from the legal instruments, the work of the monitoring systems, and the resulting findings and jurisprudence. The book proposes that the gap needs to be addressed through a new United Nations Convention on the Elimination of All Forms of Violence against Women, or alternatively an Optional Protocol to the Convention on the Elimination of all Forms of Discrimination against Women. A new Convention or Optional Protocol would be part of the transformative agenda that is needed to normatively address the promotion of a life free of violence for women, the responsibility of states to act with due diligence in the elimination of all forms of violence against all women, and the systemic challenges that are the causes and consequences of such violence.

Book excerpt: The United Nations Convention on the Elimination of all Forms of Discrimination against Women - as other international instruments - was negotiated in an international and multicultural context by diplomats and politicians from a number of countries. It dealt with a highly sensitive issue, the position and role of women in society and in the political decision-making process. The vast number of extensive reservations to the Convention bear witness to the fact that this is possibly one of the most contentious topics at the international level. Few other core universal human rights conventions have attracted a comparable number of reservations. This unique Guide is an attempt to create a picture of the legal--political background to the Convention. Its basic layout follows the style of a classical commentary with annotations to the individual provisions. These annotations draw on documentary sources from the years of preparatory discussions and negotiations (the travaux préparatoires). It primarily covers the genesis of the Convention, i.e. the drafting and negotiating process up to its adoption in 1979. To enhance the Guide's usefulness, a number of more recent documents have been incorporated, for example, the General Recommendations issued by the Committee on Elimination of Discrimination against Women have been reproduced and references to relevant recommendations have been inserted in the annotations to each provision in question. In addition to this, a number of other documents relative to the interpretation of the Convention have been reproduced in Part III, including lists of ratifications of and reservations to the Convention. Furthermore, lists of relevant global and regional instruments and case law have been compiled.
