Book excerpt: A l'instar de nombreux pays en développement, le Mali a entamé, aux débuts de la décennie 1980, un large processus de libéralisation et de privatisation de son secteur économique. Ce processus de libéralisation, qui constitue, en fait, la mise en œuvre des recommandations des bailleurs de fonds notamment le FMI et la Banque mondiale, s'est accéléré avec l'intégration du pays dans deux organisations sous-régionales économiquement intégrées que sont la CEDEAO et l'UEMOA. Avec son adhésion à l'OMC en 1994, le pays insère un marché mondialisé, résolument gouverné par les règles du libéralisme économique. A l'égard du consommateur d'aliments, le postulat est que la libéralisation des ressources agricoles et des marchés alimentaires, ainsi que l'ouverture du pays aux échanges sous-régionaux et mondiaux, permettent d'accroître la production alimentaire, de diversifier et de garantir la disponibilité des denrées alimentaires. De plus, le libre jeu de la concurrence qu'instaure la libéralisation du marché permet d'engendrer une compétition entre opérateurs économiques qui conduit à l'augmentation de la qualité des denrées alimentaires et à une diminution de leurs prix au profit des consommateurs. Pourtant, le constat aujourd'hui est celui d'une difficulté des consommateurs des pays en développement à accéder à l'aliment. A la source de cette difficulté se trouvent le droit du commerce international et les choix de la mondialisation, plus orientés vers le développement du libre-échange et la protection des intérêts économiques et financiers des acteurs de la mondialisation que vers l'accès des consommateurs à l'aliment. Ainsi, la construction d'espaces juridiques, à l'échelle régionale et mondiale, dominés par la loi du marché, participe-t-elle à l'affaiblissement du rôle de l'Etat dans la détermination des politiques agricoles et alimentaires pour préserver l'accès des consommateurs à l'aliment. Des nouvelles voies doivent être envisagées afin que le droit du libéralisme économique participe à ce qui doit être la fonction première du droit, à savoir la protection des valeurs essentielles à l'existence humaine, au premier rang desquelles se trouve l'accès à une alimentation saine et suffisante.

Pre-publication censorship was common in absolutist regimes in Catholic and Protestant countries alike, but how effective it was in practice remains open to debate. The Netherlands and England, where critical content segued into outright lampoonery, were unusual for hard-wired press freedoms that arose, respectively, from a highly competitive publishing industry and highly decentralized political institutions. These nations remained extraordinary exceptions to a rule that, for example in France, did not end until the revolution of 1789. Here, the author’s European perspective provides a survey of the varying censorship regulations in European nations, as well as the shifting meanings of ‘freedom of the press’. The analysis opens up fascinating insights, afforded by careful reading of primary archival sources, into the reactions of censors confronted with manuscripts by authors seeking permission to publish.
