Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises. 2. The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary. In the context of an effective democracy and respect for human rights mentioned in the Preamble to the European Convention on Human Rights, freedom of expression is not only important in its own right, but it also plays a central part in the protection of other rights under the Convention. Without a broad guarantee of the right to freedom of expression protected by independent and impartial courts, there is no free country, there is no democracy. This general proposition is undeniable. This handbook is a practical tool for legal professionals from Council of Europe member states who wish to strengthen their skills in applying the European Convention on Human Rights and the case law of the European Court of Human Rights in their daily work.

The European Union, founded to promote ‘ever closer’ integration, aims nominally for peaceful, prosperous cooperation. But this ideal has been battered by a series of bruising crises, and now by war. Protecting Democracy in Europe examines how, in this brave new world, the EU can and must safeguard democratic governance within its member states. Reviewing the Union’s past responses, Tom Theuns demonstrates that its existing laws and policies are normatively and expressively incoherent. Its failure to defend democratic values is unsurprising: the EU’s existing toolbox is based on an impoverished conception of democracy, and runs counter to its fundamental principles. Close attention to speeches by European Commissioners shows that they see democracy in a technical and legalistic way. This perspective–‘democracy without politics’–is easy for would-be autocrats to exploit. To protect democracy in Europe, Theuns argues, the EU must urgently correct policies that make it complicit in democratic backsliding. It must contain autocratic influences (within the strict limits of its political authority). And it must cultivate pluralist democracy within its constituent countries. But where this fails, he concludes, autocratic members should be expelled.

Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The OECD defines Civic Space as the set of legal, policy, institutional, and practical conditions necessary for non-governmental actors to access information, express themselves, associate, organise, and participate in public life. This document presents the Civic Space Scan of Finland, which was undertaken at the request of the Finnish government and is the first OECD report of its kind. OECD Civic Space Scans in particular assess how governments protect and promote civic space in each national context and propose ways to strengthen existing frameworks and practices. The Scan assesses four key dimensions of civic space: civic freedoms and rights, media freedoms and digital rights, the enabling environment for civil society organisations, and civic participation in policy and decision making. Each respective chapter of the report contains actionable recommendations for the Government of Finland. As part of the scan process, a citizens' panel - also overseen by the OECD - was held in February 2021 and generated a wide range of recommendations for the government from a representative microcosm of Finnish society.

Proposed are a set of democratic innovations, ranging from citizens assemblies to regulatory gaming to citizens initiatives and lobbying, which are complementary, not antagonistic, to existing representative democracy across the European continent. These innovations are emerging bottom-up across the continent and getting traction at local, national and EU level in a new era powered by technology. This book brings together academics as well as practitioners to give a forward-looking, holistic view of the realities of EU citizen participation across the spectrum of participatory opportunities. They all converge in arguing that, after many years of proven experimentation, the EU must institutionalize supranational, participative and deliberative, democratic channels to complement representative democracy and each other, and ultimately improve the effectiveness of EU citizen participation. While this institutional approach will not magically treat the EU democratic malaise, it should make the system more intelligible, accessible, and ultimately responsive to citizen demand without necessarily undertaking Treaty reform. The attempt to harness citizen participation to help address the current EU crisis needs the type of multi-faceted approach presented in this book. In a comparative analysis of Guatemala, El Salvador, Costa Rica, Honduras, and Nicaragua, James Mahoney argues that these political differences were legacies of the nineteenth-century liberal reform period. Presenting a theory of "path dependence," Mahoney shows how choices made at crucial turning points in Central American history established certain directions of change and foreclosed others to shape long-term development. By the middle of the twentieth century, three types of political regimes characterized the five nations considered in this study: military-authoritarian (Guatemala, El Salvador), liberal democratic (Costa Rica), and traditional dictatorial (Honduras, Nicaragua). As Mahoney shows, each type is the end point of choices regarding state and agrarian development made by these countries early in the nineteenth century. Applying his conclusions to present-day attempts at market creation in a neoliberal era, Mahoney warns that overzealous pursuit of market creation can have severely negative long-term political consequences. The Legacies of Liberalism presents new insight into the role of leadership in political development, the place of domestic politics in the analysis of foreign intervention, and the role of the state in the creation of early capitalism. The book offers a general theoretical framework that will be of broad interest to scholars of comparative politics and political development, and its overall argument will stir debate among historians of particular Central American countries.
