Book excerpt: The Prosecution and Defense of Peacekeepers under International Criminal Law is the first comprehensive study on the international judicial implications of prosecution of international peacekeepers and members of military crisis operations under the principles of international criminal law and especially those of the International Criminal Court (ICC). Based on both domestic case law and that of the ICTY-ICTR, this study analyzes the foundation and application of international criminal liability concepts and defenses from the perspective of the prosecution and defense in the area of peacekeeping. This book assesses whether prosecution of international peacekeepers merits a distinct judicial position due to (UN) peacekeeping mandates as well as the concept of Rules of Engagement. Special attention is paid to the new era of international military crisis operations in terms of prosecution and defense of military servicemen involved in these operations. This book was released on 2021-04-30 with total page 696 pages. Available in PDF, EPUB and Kindle. Book excerpt: The power of the modern prosecutor arises from several features of the criminal justice landscape: widespread use of law and order political rhetoric and heightened fear of crime among voters; legislatures' embrace of extreme sentencing ranges to respond to such concerns; and the uncertain or limited accountability of prosecutors to the electorate, the bar, or other political and professional constituencies. The convergence of these trends has transformed prosecution into an indispensable field of study. This volume brings together the work of leading international scholars across criminology, sociology, political science, and law - along with contributions from reform-minded practitioners - to examine a variety of issues in prosecutorial behaviour and the institutional structures that frame their behavior. The Handbook connects the dots among existing theoretical and empirical research related to prosecutors. Major sections of the volume cover (1) prosecutor performance during distinct phases of a criminal case, (2) the features of the prosecutor's environment, both inside the office and external to the office, that influence the choices of individual prosecutors and office leaders, and (3) prosecutorial strategies and priorities when dealing with specialized types of crimes, victims, and defendants. Taken together, the chapters in this volume identify the founding texts, discuss leading theoretical and methodological approaches, explain the scope of unresolved issues, and preview where this field is headed. The volume provides a bottom-up view of an important new scholarly field.

Available in PDF, EPUB and Kindle. Book excerpt: You watched The People v. O.J. Simpson. Now read the explosive inside story in this behind-the-scenes account of the trial. From June 13, 1994, to October 3, 1995, Robert Shapiro stood in the middle of a drama that held millions of Americans in thrall. In this book, the architect of the defense strategy tells the inside story of the O.J. Simpson trial from the beginning. With candor, wit, and compassion, the man who assembled the "dream team" brings to light the details of what has been called "the trial of the century," giving us revealing glimpses of the defendant and the others whose names have become so familiar: Johnnie Cochran, F. Lee Bailey, Marcia Clark, Judge Lance Ito, Chris Darden. Search for Justice deepens our understanding of the role and duty of a defense attorney, the "reasonable doubt" conclusion of the jury, and the place this story occupies in our culture.

Available in PDF, EPUB and Kindle. Book excerpt: Every day decisions made by prosecutors, before trial takes place, critically affect the rights of citizens; yet these decisions remain a grey area in the administration of criminal justice. In fact, there are considerable and important differences between what the prosecutor does and what the legal literature and judicial decisions say he should do. Very little is known about the powers wielded by prosecutors and the factors which influence their exercise of discretion. This inquiry focuses on the decision-making role of the prosecutor in pre-trial determinations. Professor Grosman describes and analyses the prosecutor's informal relations with the police and defence lawyers, and the significance these relationships have for the accused and for the fair administration of justice. Other areas examined include the decision to begin prosecution, the negotiated guilty plea, and the prosecutor's administrative bias. The study concludes with recommendations for judicial and legislative reform. Professor Grosman has added a preface to this edition outlining the changes that have occurred in recent years. A lucid and revealing description of the prosecutor's attitudes to criminal prosecution and its operation, this study contributes important insights valuable to lawyers and all those concerned with the administration of justice, and will be of interest to everyone concerned with social problems.

Book excerpt: This title was first published in 2003. In this study, the author examines the behavior of one group of court-appointed defence attorneys and reaches the conclusion that although, in contrast to popular opinion, these attorneys maintain an adversarial stance against the prosecutors and behave in a legally ethical (or "procedurally just") manner, case outcomes are unduly shaped by social class and are therefore substantively unjust. This occurs because poor defendants typically lack cultural rhetoric that favourably influences those who construct and operate the criminal court system. Ironically, this indicates that, in many cases, the process of plea bargaining may be more substantively just than trials. A major contribution of the study is the detailed analysis of the manner by which oppression and substantive injustice occur in the adjudication of many cases and how the cultural practices of the powerful can frequently misconstrue, exclude and mute the voices of the poor.

Shellow's book, now in its second edition with some new material, offers what its title promises: ways of thinking about cross-examining the forensic analysts in drug cases, with Shellow's peerless examples in abundance. But the book is so much more than this. It offers a look inside the mind of one of the finest cross-examiners and defense lawyers the United States has produced in the last seventy years. Shellow's psychological insights, his grasp of chemistry (which he shares with readers), his style, his recognition of the parallels between criminal trials and jazz, his fierce devotion to intellectual clarity and to deep preparation: all of these qualities guide us well beyond any particular class of witness or any type of criminal charge. Read thoughtfully, this small book can inspire and direct you in making big changes in the way you defend your clients and think about the entire project of trying any case. It is a magnum opus in miniature, a gift to the busy lawyer, from one of the nation's preeminent trial lawyers.

Available in PDF, EPUB and Kindle. Book excerpt: Every year, millions of people across Europe - innocent and guilty - are arrested and detained by the police. For some, their cases go no further than the police station, but many others eventually appear before a court. Many will spend time in custody both before and following trial. Initial attempts by the European Union to establish minimum procedural rights for suspects and defendants failed in 2007, in the face of opposition by a number of Member States who argued that the European Court of Human Rights (ECHR) rendered EU regulation unnecessary. However, with ratification of the Lisbon Treaty, criminal defense rights are again on the agenda. Based on a three year research study, this book explores and compares access to effective defense in criminal proceedings across nine European jurisdictions (Belgium, England/Wales, Finland, France, Germany, Hungary, Italy, Poland, and Turkey) that constitute examples of the three major legal traditions in Europe: inquisitorial, adversarial, a
