Book excerpt: This volume examines the property transformations in post-communist Central Eastern Europe (CEE) and focuses on the role of restitution and privatisation in such transformations. It argues that the theorisation of ‘restitution’ in post-communist CEE is incomplete in the transitional justice scholarship and in the literature on correction of historical wrongs. The book also argues that, for a more complete theorisation of (post-communist) restitution, the transformations of property in post-communist societies ought to be studied in a more holistic way. The main legal vehicles used for such transformations, privatisation and restitution, should not be studied separately and in abstract, but in their reciprocal relationship, and in connection to the dimension of justice which each could achieve. Finally, the book integrates ‘privatisation’ in a theory of post-communist transformation of property.

Available in PDF, EPUB and Kindle. Book excerpt: In the post-communist era it has become evident that the emerging democracies in Eastern Europe will be determined by many factors, only some of them political. Throughout the region, the Orthodox, Roman Catholic, and Greek Catholic churches have tried to impose their views on democracy through direct political engagement. Moreover, surveys show that the churches (and the army) enjoy more popular confidence than elected political bodies such as parliaments. These results reflect widespread disenchantment with a democratization process that has allowed politicians to advance their own agendas rather than work to solve the urgent socio-economic problems these countries face. In this penetrating study, Lavinia Stan and Lucian Turcescu investigate the interaction of religion and politics in one such country, Romania. Facing internal challenges and external competitions from other religions old and new, the Orthodox Church in Romania has sought to consolidate its position and ensure Romania's version of democracy recognizes its privileged position of "national Church", enforcing the Church's stances on issues such as homosexuality and abortion. The post-communist state and political elite in turn rely on the Church for compliance with educational and cultural policies and to quell the insistent demands of the Hungarian minority for autonomy. Stan and Turcescu examine the complex relationship between church and state in this new Romania, providing analysis in key areas: church collaboration with communist authorities, post-communist electoral politics, nationalism and ethno-politics, restitution of Greek Catholic property, religious education, and sexual behavior and reproduction. As the first scholars to be given access to confidential materials from the archives of the communist political police, the notorious Securitate, Stan and Turcescu also examine church archives, legislation, news reports, and interviews with politicians and church leaders. This study will move the debate from common analyses of nationalism in isolation to more comprehensive investigations which consider the impact of religious actors on a multitude of other issues relevant to the political and social life of the country.

Kuti examines property reparations that took place after 1989, from the perspective of constitutional justice, the rule of law, but also from the point of view of identity politics.

Book excerpt: The European system of human rights protection faces institutional and political pressures which threaten its very survival. These institional pressures stem from the backlog of applications before the European Court of Human Rights, the large number of its judgments that remain unimplemented, and the political pressures that arise from sustained attacks on the Court's legitimacy and authority, notably from politicians and jurists in the United Kingdom. This book addresses the theme which lies at the heart of these pressures: the role of national parliaments in the implementation of judgments of the Court. It combines theoretical and empirical insights into the role of parliaments in securing domestic compliance with the Court's decisions, and provides detailed investigation of five European states with differing records of human rights compliance and parliamentary mobilisation: Ukraine, Romania, the United Kingdom, Germany, and the Netherlands. How far are parliaments engaged in implementation, and how far should they be? Do parliaments advance or hinder human rights compliance? Is it ever justifiable for parliaments to defy judgments of the Court? And how significant is the role played by the Parliamentary Assembly of the Council of Europe? Drawing on the fields of international law, international relations, political science, and political philosophy, the book argues that adverse human rights judgments not only confer obligations on parliamentarians but also create opportunities for them to develop influential interpretations of human rights and enhance their own democratic legitimacy. It makes an authoritative contribution to debate about the future of the European and other supranational human rights mechanisms and the broader relationship between democracy, human rights, and legitimate authority.

Book excerpt: Holocaust Restitution is the first volume to present the Holocaust restitution movement directly from the viewpoints of the various parties involved in the campaigns and settlements. Now that the Holocaust restitution claims are closed, this work enjoys the benefits of hindsight to provide a definitive assessment of the movement. From lawyers and State Department officials to survivors and heads of key institutes involved in the negotiations, the volume brings together the central players in the Holocaust restitution movement, both pro and con. The volume examines the claims against European banks and against Germany and Austria relating to forced labor, insurance claims, and looted art claims. It considers their significance, their legacy, and the moral issues involved in seeking and receiving restitution. Available in PDF, EPUB and Kindle. Book excerpt: "Becoming a member of the European Union is one of the most important objectives of the Czech Republic for the coming years, both for the government, and for the Czech society as a whole." With the exception of a few traditional Czech products, the Czech Republic is not a major exporter of agricultural goods due to its land-locked position and relatively poor product differentiation. Since the "velvet revolution" in 1989, agricultural production has declined. To conform to European Union standards for accession, the Czech Republic needs to make some adjustments. This report reviews the current state of Czech agriculture and agro-industry in the context of EU accession. It analyzes institutional reforms and their actual impacts and proposes a series of adjustments to complete the reforms in the agricultural sector. This report is intended for agricultural scientists, public officials, agricultural and agro-industrial leaders, and researchers interested in the transformation of agriculture in the transition economies and in issues pertaining to accession of Central and East European candidate countries to the European Union.
