Available in PDF, EPUB and Kindle. Book excerpt: In this essay, Monaghan argues for an account of property possession as strict, numerical identity. According to this account, for an entity to possess a property is for that entity and that property to be numerically identical to each other. To defend this view, he argues against two views he call Externalism and Internalism about property possession. Monaghan argues that it is impossible for one entity to possess a second entity as a property. He provides replies to variety of objections one might raise against his account.

Book excerpt: The thesis of this paper is that no real distinction obtains between property possession and identity. To justify this thesis, I argue against two views I call Exteriorism and Interiorism, I argue for an account of property possession and identity according to which they are one and the same relation, and I respond to a wide variety of objections to that account.

Book excerpt: ABSTRACT: The late nineteenth and early twentieth century in America is an interesting time when examined through the lens of property ownership and self ownership. Technically and legally, married women could own property and many had enjoyed this right since the first Married Women's Property Acts in the 1840s. Technically and legally, African Americans enjoyed freedom and the rights as citizens of the United States. Additionally, authors were gaining rights of ownership over their published texts in a manner striking in its contrast to the culture of reprinting that thrived mid-century. We can understand these three systems of ownership as interrelated as they all connectively feature in the debate over who will have power and access to power in the late nineteenth and early twentieth century and as they all have a significant role to play in the attempt to preserve national manhood.

A wider range of social identities, including race, gender, sexual orientation, marital status, and citizenship status. New material to the Black Lives Moment including material on debates over memorials, reparations, and transportation. New material on the Asian-American experience related to property law including the migration of Asian-Americans, the barriers to property ownership for Asian-Americans, and citizenship status for Asian-Americans. Expanded discussion of Native American and tribal identity, including a consideration of the status of Native Hawaiians, and the status of Black members of tribal entities. Comparative and international law materials in property law including Haiti, South Africa, the European Union, and Australia. Different approaches to social identities, including critical race theory, progressive property theory, and social and political history. Benefits for instructors and students: A rich selection of cases that explore the relationship between citizenship, social identity, status, and property interest, including Dred Scott v. Sandford, United States v. Singh, and Oyama v. California. A critical look at how the law of dispossession was shaped by contact and conquest of Native Americans and enslavement of Black people, and the efficacy and fairness of traditional property concepts as applied to minority or cultural requirements: An exploration of how reorganization of property systems facilitates both social disruption and reordering, including The Haitian Constitution of 1801 and Moore v. Cleveland A consideration of how property law can be used to rectify or repair currently existing inequality, including removal of statutes, land partition, and recent responses to Black Lives Matter Insightful analysis of federal civil rights statutes and their implications for environmental justice, housing, and civil rights law through the “space” of neighborhood. Book excerpt: In today's market economies, people constitute much of their identity in relation to the things they possess, and communities facilitate social intercourse and survival by means of property relations. What, if anything, might the study of the biblical religions contribute to thinking about and responding to the basic reality of "having"? In this book scholars in a variety of fields -- theology, ethics, economics, and biblical studies -- address in new and penetrating ways the meaning of "having" in religious and social life and offer a number of compelling answers to challenging questions about property and possession in our present, global age.

Available in PDF, EPUB and Kindle. Book excerpt: The papers in this volume address fundamental, and interrelated, philosophical issues concerning modality and identity, issues that have not only been pivotal to the development of analytic philosophy in the twentieth century, but remain a key focus of metaphysical debate in the twenty-first. How are we to understand the concepts of necessity and possibility? Is chance a basic ingredient of reality? How are we to make sense of claims about personal identity? Do numbers requiredistinctive identity criteria? Does the capacity to identify an object presuppose an ability to bring it under a sortal concept?Rather than presenting a single, partisan perspective, Identity and Modality enriches our understanding of identity and modality by bringing together papers written by leading researchers working in metaphysics, the philosophy of mind, the philosophy of science, and the philosophy of mathematics. The resulting variety of perspectives correspondingly reflects both the breadth and depth of contemporary theorizing about identity and modality, each paper addressing a particular issue andadvancing our knowledge of the area. This volume will provide essential reading for graduate students in the subject and professional philosophers.

Available in PDF, EPUB and Kindle. Book excerpt: The philosophical problem of identity and the related problem of change go back to the ancient Greek philosophers and fascinated later figures including Leibniz, Locke, and Hume. Heraclitus argued that one could not swim in the same river twice because new waters were ever flowing in. When is a river not the same river? If one removes one plank at a time when is a ship no longer a ship? What is the basic nature of identity and persistence? In this book, André Gallois introduces and assesses the philosophical puzzles posed by things persisting through time. Beginning with essential historical background to the problem he explores the following key topics and debates: mereology and identity, including arguments from 'Leibniz's Law' the constitution view of identity the 'relative identity' argument concerning identity temporary identity four-dimensionalism, counterpart and multiple counterpart theory supervenience the problem of temporary intrinsics the necessity of identity Indeterminate identity presentism criteria of identity conventionalism about identity. Including chapter summaries, annotated further reading and a glossary, this book is essential reading for anyone seeking a clear and informative introduction to and assessment of the metaphysics of identity.

Book excerpt: With socialism largely discredited in recent years, the moral and legal status of private property has become an increasingly important area for discussion in contemporary political and social thought. Offering a contribution to legal theory, and to political and social philosophy, this work examines the two currently dominant traditions - those of neo-conservative utilitarianism and liberal communitarianism - emphasizing the strengths of both approaches and laying the groundwork for a theory to bridge the gap between them.
