Book excerpt: The book examines the phenomenon of immigration federalism: its main characteristics, why and how it has developed, its implications for immigration systems (in general) and non-citizens’ rights (in particular). The book introduces the reader to theoretical perspectives on immigration federalism through three sets of literature – federalism, governance and non-citizens’ rights – that provide a necessary framework for understanding immigration federalism’s multiple facets and impacts. It also offers an analysis of immigration federalism through case studies of six jurisdictions: Australia, Canada, Germany, Switzerland, the EU and the US. Despite increased sub-national activity in immigration regulation in several federal states, very little research has been dedicated so far to comparing how federal states deal with immigration federalism. Comparative studies on the human rights implications of immigration federalism have received even less attention. This book seeks to fill the gap in this area and is an important contribution to the field, providing the reader with a better understanding of the complex issues surrounding immigration federalism and its impact on non-citizens.

This book was released on 2008-01-01 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: An important provision of the European Convention on Human Rights is that in the event of a violation being found, not only is the state in question required to redress the consequences of the violation vis-á-vis the applicant - by such means as reopening of proceedings at the origin of the violation, reversal of a judicial verdict, discontinuation of expulsion proceedings or, where necessary, payment of a monetary award to the applicant; but it must also take general measures to prevent the repetition of the violation. These latter measures may take the form, for example, of a change in legislation, recognition of the Court's judgment in national case-law, the appointment of extra judges or magistrates to absorb a backlog of cases, the construction of detention centres suitable for juvenile delinquents, the introduction of training for the police, or other similar steps. This second edition continues to examine both individual measures and general measures taken by states in accordance with the Court's judgments and with the supervisory proceedings of the Committee of Ministers, as published in its human rights (DH) resolutions.

Available in PDF, EPUB and Kindle. Book excerpt: Swiss citizens approve of their government and the way democracy is practiced; they trust the authorities and are satisfied with the range of services Swiss governments provide. This is quite unusual when compared to other countries. This open access book provides insight into the organization and the functioning of the Swiss state. It claims that, beyond politics, institutions and public administration, there are other factors which make a country successful. The authors argue that Switzerland is an interesting case, from a theoretical, scientific and a more practice-oriented perspective. While confronted with the same challenges as other countries, Switzerland offers different solutions, some of which work astonishingly well.

Book excerpt: By considering the distinctiveness of the inter-war years as a discrete period of colonial change, this book addresses several larger issues, such as tracing the origins of decolonization in the rise of colonial nationalism, and a re-assessment of the impact of inter-war colonial rebellions in Africa, Syria and Indochina. The book also connects French theories of colonial governance to the lived experience of colonial rule in a period scarred by war and economic dislocation.

Book excerpt: This edited volume presents an analysis of the evolution of French language policies and their impact on French regional languages and their communities. It gathers studies on language revitalisation from several territorial minority languages (Breton, Alsatian, Catalan, Occitan, Basque, Corsican, Francoprovençal, Picard, Reunionese) and evaluates the challenges and opportunities that they face in the 21st century. The chapters tackle different aspects of language endangerment and language planning and adopt varied theoretical and methodological approaches. The first section of the book reconsiders the difficulties in establishing linguistic boundaries and classification for some regional languages. The second section examines the important theme of the new generation of speakers with issues of transmission and identity formation and the changes they can bring to traditional communities. The third section highlights new developments in the context of new technologies and the heightened visibility of regional languages. Finally, the last section presents an overview of the contemporary situation of minority language revitalisation in France and synthesises the key trends identified in this volume: from the educational domain to the European Charter for Minority and Regional languages. This book will appeal to students and scholars of the sociology of language, sociolinguistics, language policy, minority languages and language endangerment.

Available in PDF, EPUB and Kindle. Book excerpt: This volume provides a series of critical analyses of some of the contemporary debates in relation to the human rights of children, resituating them within visions which informed the text of the United Nations Convention on the Rights of the Child in 1989. The studies embrace examination of some of today's widespread interpretations of the CRC, analysis of what is implied by a human rights-based approach in research and advocacy and consideration of advances and barriers to research and to several aspects of CRC implementation. With contributions by leading experts in the field, the book examines the CRC as an international instrument, its inherent dilemmas and some of the debates generated by the challenges of implementation. It embraces examinations of different levels of governance from the international to the state party, regional and local levels, including institutional developments and changes in law, policy and practice. The book will be a valuable resource for students, researchers and policy-makers working in the area of children's rights and welfare.

In this revised and updated edition, Keyssar carries the story forward, from the disputed presidential contest of 2000 through the 2008 campaign and the election of Barack Obama. The Right to Vote is a sweeping reinterpretation of American political history as well as a meditation on the meaning of democracy in contemporary American life.

Available in PDF, EPUB and Kindle. Book excerpt: Burning the Veil draws upon sources from newly-opened archives, exploring the "emancipation" of Muslim women from the veil, seclusion and perceived male oppression during the Algerian War of decolonization. The claimed French liberation was contradicted by the violence inflicted on women through rape, torture, and destruction of villages. This book examines the roots of this contradiction in the theory of "revolutionary warfare", and the attempt to defeat the National Liberation Front by penetrating the Muslim family, seen as a bastion of resistance. Striking parallels with contemporary Afghanistan and Iraq, French "emancipation" produced a backlash that led to deterioration in the social and political position of Muslim women. This analysis of how and why attempts to Westernize Muslim women ended in catastrophe has contemporary relevance and will be important to students and academics engaged in the study of French and colonial history, feminism, and contemporary Islam.
