Book Synopsis Trans Rights and Wrongs by : Isabel C. Jaramillo
Download or read book Trans Rights and Wrongs written by Isabel C. Jaramillo and published by Springer Nature. This book was released on 2021-06-23 with total page 552 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book maps various national legal responses to gender mobility, including sex and name registration, access to gender modification interventions, and anti-discrimination protection (or lack thereof) and regulations. The importance of the underlying legislation and history is underlined in order to understand the law’s functions concerning discrimination, exclusion, and violence, as well as the problematic nature of introducing biology into the regulation of human relations, and using it to justify pain and suffering. The respective chapters also highlight how various governmental authorities, as well as civil society, have been integral in fostering or impeding the welfare of trans persons, from judges and legislators, to medical commissions and law students. A collective effort of scholars scattered around the globe, this book recognizes the international trend toward self-determination in sex classification and a generous guarantee of rights for individuals expressing diverse gender identities. The book advocates the dissemination of a model for the protection of rights that not only focuses on formal equality, but also addresses the administrative obstacles that trans persons face in their daily lives. In addition, it underscores the importance of courts in either advancing or obstructing the realization of individual rights.

Book Synopsis The Divided Path by : Allan Mitchell
Download or read book The Divided Path written by Allan Mitchell and published by UNC Press Books. This book was released on 2018-02-01 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: With The Divided Path, Allan Mitchell completes his superb trilogy on the German influence in France between the wars of 1870 and 1914. Mitchell's focus here is on the French response to the pathbreaking social legislation passed during the 1880s in imperial Germany under Otto von Bismarck. Operating under a liberal republican regime, France tended to reject the interventionist policies of its imposing neighbor and to seek a distinctly French solution to the many social problems that became more pressing as the nineteenth century reached its climax in the First World War. Mitchell's carefully researched study investigates a number of specific issues that remain of direct relevance today, such as gender relationships, health care (including the treatments and prevention of infectious disease), labor conflicts, taxation policy, social security measures, and international tensions on the eve of a major war. He shows that certain key problems of public health and welfare found different solutions in France and Germany, and he explains why the differences emerged and how they defined the two major competitors of continental Europe. The nineteenth-century epidemic of tuberculosis provides a case in point: the German state intervened to combat the dreaded disease with vigorous measures of public hygiene and popular sanatoria, but the French republic moved more cautiously to limit interference in the private sphere, even though laissez faire often meant laissez mourir. Mitchell's book is the first full-scale study of French social reform after 1870 that is based on documentation in both France and Germany. The first hesitant steps of the French welfare state are thrown into sharp relief by comparison with developments in Germany. No other work on modern France presents such a broad panorama of social reform, and none draws together such a rich tableau of telling detail about the development of the French health and welfare system after 1870. In a lucid conclusion, Mitchell places this story in the general context of his three volumes, thereby offering a summary of the Franco-German encounter that has come to dominate the history of Europe in the twentieth century. Book Synopsis A Written Constitution for Quebec? by : Richard Albert
Download or read book A Written Constitution for Quebec? written by Richard Albert and published by McGill-Queen's Press - MQUP. This book was released on 2023-01-15 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: No province in Canada has codified a written constitution, and whether Quebec should be the first remains a controversial question. A Written Constitution for Quebec? enters into the debate, drawing a roadmap through the legal, political, and constitutional terrain of the issue. Leading scholars each take their own position in the debate, examining the issue from various sides and exploring the forms and limits of a codified Quebec constitution by asking whether Quebec should adopt a written constitution, how the province might go about it, and what such a document might achieve. Along with a comprehensive introduction to constitutional codification and how it relates to Quebec, the book opens with a proposal for a written constitution, with the analyses that follow expressing a diversity of views on the feasibility and desirability of a written constitution for the province. An array of perspectives through the lenses of Indigenous inclusion and reconciliation, interculturalism and democratic constitutionalism, and insights from other federal and plurinational states – are included in this wide-ranging volume. Taking a doctrinal, historical, theoretical, and comparative approach, A Written Constitution for Quebec? extensively addresses Quebec’s constitutional future in Canada.
