Available in PDF, EPUB and Kindle. Book excerpt: Peace as Government: The Will to Normalize Timor-Leste brings a problematization of post-conflict reconstruction processes by bridging two theoretical approaches that are often placed in diametrical opposite epistemic poles – the analytical tools developed by Michel Foucault and the English School. The author argues that peace operations have a very precise function in the international scenario – the fostering and the maintenance of a (neo)liberal order in the international society. He evinces that this particular function of peace operations is developed through the will to normalize post-conflict states and their populations. In order to advance his argument, the author analyses the United Nations’ (UN) engagement with Timor-Leste, since no other country had the large number of peace operations, the wide range of spheres of engagement or the depth of involvement that the UN had in Timor-Leste. The author evinces that this will to normalize Timor-Leste is rendered operational though the mechanism of government, the conduct of conducts in a Foucauldian sense, functioning in two levels. At the international level, the government operates through discipline, rewarding and punishing the Timorese state seeking to shape its behaviors as an individual in the international society. At the national level, the government operates through biopolitics, which functions through the attempt of shaping the life-supporting processes of the Timorese population.

This book was released on 2011-11-30 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Parliamentary Ombudsman, Ann Abraham, has upheld complaints from nine farmers about the Government's handling of a subsidy scheme which caused them to miss out on payments they were entitled to. The farmers complained to the Ombudsman about the administration of the Single Payment Scheme (SPS) in 2005 and 2006 by the Rural Payments Agency (RPA), part of the Department for Environment, Food and Rural Affairs (Defra), The SPS is the latest generation of the EU schemes intended, among other policy aims, to give farmers direct income support. The farmers complained about RPA's handling of their claims to the SPS on a number of counts, including that they provided poor quality and sometimes ambiguous guidance on how to make a claim; failed to return applicants' telephone calls when this had been promised; misdirected applicants about the status of their cases; delayed letting applicants know that they would not be paid; and did not explain their decisions properly. RPA also failed to consider the effects their errors and omissions had on the farmers when they came to complain. In one case, a farmer misunderstood the new form and only claimed a subsidy for the year 2005. She did not activate her claim and subsequently did not receive a payment. No one questioned her mistake, even though RPA knew this was a common error by farmers. Losing a payment of over £13,000 left the farmer unable to pay all her bills and reliant on her partner's goodwill. She found out her mistake almost a year after submitting her claim, when she asked what had happened to her payment. Another farmer also misunderstood the new form and guidance and did not activate his claim. He was then led to believe by the RPA that he would be paid, which was not the case. He and his wife found the confusion and uncertainty of their circumstances particularly stressful. The farmer had to increase his overdraft, sell land and take on extra part time work in order to meet the financial shortfall. As a result of the Ombudsman's investigation the farmers will each receive a written apology from the Permanent Secretary of Defra and compensation of £500 for the inconvenience, distress and frustration that they experienced. They will also receive individual payments to put right the financial impact of RPA's failures. In addition, the Ombudsman has also asked RPA to provide an action plan setting out the changes they have made to prevent other farmers experiencing the same problems in future.

This book was released on 2021-04-01 with total page 756 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book centres on the war that raged between Eritrea and Ethiopia from 1998 to 2000, a war that caused great loss of life and tremendous devastation. It analyses the war in great detail from an international legal perspective: the nature and the state of the boundary conflict preceding the actual armed conflict, the military actions themselves, the role of the UN peace-keeping mission, the responsibility for the multitude of explosive remnants of the war left behind. Ample attention is paid to the decisions of the Eritrea-Ethiopia Claims Commission and the Eritrea-Ethiopia Boundary Commission. This study is not limited to the war and the period immediately following it, it also examines its more extended aftermath prolonging the analysis as far as the more recent improvement in the relations between Eritrea and Ethiopia, away from a situation of ‘no war, no peace’ that prevailed after the armed conflict ended. The analysis of the war and its aftermath is not only in terms of international legal issues, it has been placed in a wider than strictly legal perspective. The book is a valuable work for academics and practitioners in international law, human rights and humanitarian law in particular, for political scientists, diplomats, civil servants, historians, and all those others seriously interested in the Horn of Africa. Andrea de Guttry is Full Professor of Public International Law at the Scuola Superiore Sant'Anna in Pisa, Italy. Harry H.G. Post is Adjunct Professor in the Faculté Libre de Droit of the Université Catholique de Lille in Lille, France. Gabriella Venturini is Professor Emerita in the Dipartimento di Studi internazionali, giuridici e storico-politici of the Università degli Studi di Milano in Milan, Italy.

Available in PDF, EPUB and Kindle. Book excerpt: This volume presents the research analysis of a range of scholars and experts on post conflict peacebuilding and international law from a variety of perspectives and missions. The selected essays show that peacebuilding, like the concept of peacekeeping, is not specifically provided for in the UN Charter. They also demonstrate that the record of peacebuilding, like that of peacekeeping, is varied and while both concepts are intrinsically linked, neither lends itself to precise definition. The essays consider the historical approaches to peacebuilding such as the role played by the UN in the Congo in the early 1960s and the work of the United States and its allies in rebuilding Germany and Japan in the aftermath of World War II. Finally, essays consider the major challenge for contemporary peacebuilding operations to make international administrations accountable and to ensure the involvement of the international community in helping rebuild communities and prevent the resurgence of violence.

Book excerpt: This book is based on the author's experience of working for more than two decades in over thirty conflict and post-conflict zones. It is written for those involved in UN peacekeeping and the protection of civilians. It is intended to be accessible to non-lawyers working in the field who may need to know the applicable legal standards relating to issues such as the use of force and arrest and detention powers on the one hand and the delivery of life-saving assistance according to humanitarian principles on the other. It will also be of interest to scholars and students of peacekeeping, international law and international relations on the practical dilemmas facing those trying to operationalise the various conceptions of 'protection' during humanitarian crises in recent years.
