Available in PDF, EPUB and Kindle. Book excerpt: "If you've got nothing to hide," many people say, "you shouldn't worry about government surveillance." Others argue that we must sacrifice privacy for security. But as Daniel J. Solove argues in this important book, these arguments and many others are flawed. They are based on mistaken views about what it means to protect privacy and the costs and benefits of doing so. The debate between privacy and security has been framed incorrectly as a zero-sum game in which we are forced to choose between one value and the other. Why can't we have both? In this concise and accessible book, Solove exposes the fallacies of many pro-security arguments that have skewed law and policy to favor security at the expense of privacy. Protecting privacy isn't fatal to security measures; it merely involves adequate oversight and regulation. Solove traces the history of the privacy-security debate from the Revolution to the present day. He explains how the law protects privacy and examines concerns with new technologies. He then points out the failings of our current system and offers specific remedies. Nothing to Hide makes a powerful and compelling case for reaching a better balance between privacy and security and reveals why doing so is essential to protect our freedom and democracy"--Jacket.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

The spread of the Internet and the seemingly boundaryless options for collecting, saving, sharing, and comparing information trigger consumer worries. Online practices of business and government agencies may present new ways to compromise privacy, and e-commerce and technologies that make a wide range of personal information available to anyone with a Web browser only begin to hint at the possibilities for inappropriate or unwarranted intrusion into our personal lives. Engaging Privacy and Information Technology in a Digital Age presents a comprehensive and multidisciplinary examination of privacy in the information age. It explores such important concepts as how the threats to privacy evolving, how can privacy be protected and how society can balance the interests of individuals, businesses and government in ways that promote privacy reasonably and effectively? This book seeks to raise awareness of the web of connectedness among the actions one takes and the privacy policies that are enacted, and provides a variety of tools and concepts with which debates over privacy can be more fruitfully engaged. Engaging Privacy and Information Technology in a Digital Age focuses on three major components affecting notions, perceptions, and expectations of privacy: technological change, societal shifts, and circumstantial discontinuities. This book will be of special interest to anyone interested in understanding why privacy issues are often so intractable.

Book excerpt: We live more and more of our lives online; we rely on the internet as we work, correspond with friends and loved ones, and go through a multitude of mundane activities like paying bills, streaming videos, reading the news, and listening to music. Without thinking twice, we operate with the understanding that the data that traces these activities will not be abused now or in the future. There is an abstract idea of privacy that we invoke, and, concrete rules about our privacy that we can point to if we are pressed. Nonetheless, too often we are uneasily reminded that our privacy is not invulnerable-the data tracks we leave through our health information, the internet and social media, financial and credit information, personal relationships, and public lives make us continuously prey to identity theft, hacking, and even government surveillance. A great deal is at stake for individuals, groups, and societies if privacy is misunderstood, misdirected, or misused. Popular understanding of privacy doesn't match the heat the concept generates. With a host of cultural differences as to how privacy is understood globally and in different religions, and with ceaseless technological advancements, it is an increasingly complex topic. In this clear and accessible book, Leslie and John G. Francis guide us to an understanding of what privacy can mean and why it is so important. Drawing upon their extensive joint expertise in law, philosophy, political science, regulatory policy, and bioethics, they parse the consequences of the forfeiture, however great or small, of one's privacy.

Book excerpt: The USA Patriot Act One is of the most controversial and possibly one of the most misunderstood laws Congress has ever enacted. For many Americans, it is synonymous with an egregious and unjustifiable suspension of the Bill of Rights. Others, troubled but more cautious, identify the Patriot Act with the grant of unprecedented powers that put civil liberties at some risk. Many who reject these concerns nonetheless accept their underlying assumption —that the Patriot Act does indeed give the federal government a package of powerful new search and surveillance tools. In Rethinking the Patriot Act, Stephen J. Schulhofer explains the act's most important provisions and reviews the best information currently available to gauge their usefulness and their effects in practice. Contrary to conventional wisdom, Schulhofer argues that much of the Patriot Act was essential, and some of it, if not essential, was reasonably defensible. In fact, the act includes provisions —seldom noticed —that add new protections for certain civil liberties, extend new benefits to certain immigrant groups, and provide new remedies for violations of individual rights. Nonetheless, Schulhofer concludes, many of the act's new powers are far too broad, and even where the case for broad powers is strong, they were typically conferred with little effort to assure transparency and accountability.

Available in PDF, EPUB and Kindle. Book excerpt: Much has been written about the USA Patriot Act, and the controversy that surrounds this far-reaching legislation has also generated a great deal of confusion and uncertainty about its impact and importance in the war on terrorism. As Professor Kam C. Wong notes in this important contribution to the literature: "There is little scholarly research on the legislation, implementation and impact of the Act". Undoubtedly, few Americans are actually aware of most of the details in the Act, or its implications in a free society. The events of September 11, 2001 in attacks on the World Trade Centre and the Pentagon prompted a unique response by Congress in passing a series of wide reaching laws, expanding the powers of law enforcement and the judiciary. Of particular concern to many are the requirements of public and private organisations to provide information in connection with homeland security that is considered intrusive and in violation of privacy rights. Ultimately, it will be many years before the actual impact of the Patriot Act can be assessed. In this new and important book, Professor Wong provides a critical analysis of the legislation and its capacity for abuse.

Book excerpt: While other books in the field focus on specific aspects of privacy or how to avoid invasions, David H. Holtzman--a master technologist, internet pioneer, security analyst, and former military codebreaker--presents a comprehensive insider's exposé of the world of invasive technology, who's using it, and how our privacy is at risk. Holtzman starts out by categorizing privacy violations into "The 7 Sins Against Privacy" and then goes on to explain in compelling and easy to understand language exactly how privacy is being eroded in every aspect of our lives. Holtzman vividly reveals actual invasions and the dangers associated with the loss of privacy, and he takes a realistic look at the trade offs between privacy and such vital issues as security, rights, and economic development. Praise for Privacy Lost "Whether we know it or not, we have all become citizens of the Digital Age. As such we need to take responsibility for our conduct, our safety, and our privacy. David Holtzman is deeply knowledgeable about the industry and passionate about the issues. Regardless of your political views, you will come away from this book better equipped to meet the challenges before us all." --Geoffrey A. Moore, author, Dealing with Darwin: How Great Companies Innovate at Every Phase of Their Evolution "Holtzman has drafted a blueprint all citizens of this great land ought to read if they desire to understand what privacy truly means, why it is important to both their everyday life as well as to their understanding of what it really means to be free, and what they can do to salvage what little privacy is left them. Privacy Lost needs to be readily available on the desks of all concerned citizens--heavily dog-eared and underlined." --Bob Barr, practicing attorney and former Member of theUnited States House of Representatives
