This book was released on 2023 with total page 0 pages. Available in PDF, EPUB and Kindle. English AbstractTransnational enterprises have caused many difficulties in different legal contexts. The answer given by International Economic Law has demanded a reform in the paradigms of the legal field: from its subordination to financial concepts and its purpose in achieving economic progress to the adoption of the protection of human and fundamental rights as synonyms of development. The result is found in a series of domestic and international legal documents, which urge, besides States and international organizations, transnational corporations to the protection of those valuable rights. In these texts, it is encouraged self-regulation by the implementation of programs of compliance and its consequent elaboration of codes of ethics. However, the main obstacle to the adoption of these initiatives is their voluntary character. This article inquires how the self-regulation carried by corporate codes could enable the protection of human and fundamental rights, and, consequently, achieve the desired development. Thorough theoretical research, with a qualitative focus, this article postulates the employment of private international law equipped with principles. In reality, this legal field performs regulatory functions, common to public law, even though it is named private. Initially, it argues that conflict of laws would be applied in a macro dimension, to confer a legal nature to corporate codes, by allowing characterize them as contracts, sources of torts, a unilateral declaration or consumer relations. Furthermore, private international law would be applied in a micro dimension, with the purpose of allowing the dialogue between different codes of ethics or with other domestic legislations. Conflict of laws' principles adapts better to achievement of development, object of International Economic Law. It is, in summary, a new answer to Economic Law, which exceeds the limits of public and private: private tools as enterprises and codes of ethics are employed to archive Public Law ends.

Available in PDF, EPUB and Kindle. Book excerpt: This book argues that law has a vital role in shaping the electricity system to enable a more active role for consumers in liberalizsed electricity industries. To do that, this book offers a unique legal perspective of the Netherlands, New Zealand and Colombia to help understand some of the current legal approaches to prosumers and therefore the legal challenges and opportunities facing. Law and regulation have the role of creating a level playing field for emerging participants, such as prosumers, to participate and compete in the market together with traditional actors, bringing not only more competition but also representing a more sustainable, environmental and democratic way to supply energy. Furthermore, law and regulation have the role of responding to innovation and creating space for technological advances to procure the changes in the industry without delay. This book examines some of the legal barriers for the raise of energy prosumers. The traditional role of the distributor when responding to increasing distributed generation in the network; prosumers unable to decide to whom they can sell their electricity to; the price of the energy or even whether to participate more actively in demand response programs. A further issue is the lack of clarity about whether small prosumers are entitled to consumer protection rights and legal challenges regarding configuration, access to the network, access to markets and strict unbundling rules for community energy projects. This book provides a clear, analytical, and informed approach to understanding the regulatory framework around energy prosumers. It will appeal to policy makers, lawyers, individuals, business entrepreneurs or communities wanting to engage in energy projects, as well as academics, researchers and students

Available in PDF, EPUB and Kindle. Book excerpt: This second volume on the constitutional dimension of contract law explores this increasingly relevant subject in jurisdictions that are usually overlooked by mainstream scholarship in the English-speaking world. With chapters on Finland and other Nordic Countries from a comparative perspective, Spain, Japan, Somalia, Nigeria, Brazil, and Peru, the contributions presented here offer much-needed, context-informed insights on whether – and if so, why, how and to what extent – the development of contract law is being influenced by constitutional values and fundamental rights issues (or vice-versa). The book represents a valuable addition to comparative law literature on the interplay between public (i.e., constitutional) and private (i.e., contract) law by revealing the inner dynamics through which these two branches interact and (at times) inform each other, whilst also enhancing our understanding of the law’s nature, function, and transformative potential at the macro, meso, and micro levels.

Book excerpt: In 1981 Chile's military government dictated a new Water Code that radically changed the country's previous water rights system by strengthening private property rights, favoring market incentives, and reducing state regulation. Against the Current: Privatization, Water Markets, and the State in Chile is the first empirical and interdisciplinary study of water markets in Chile, which is the leading international example of free market water policies. Against the Current: Privatization, Water Markets, and the State in Chile challenges the glowing reports given by neoliberals in Chile and the World Bank, showing that the results of this economic experiment have actually been rather mixed. Within the agricultural sector the Water Code has worked fairly well, although the market incentives to conserve water have been ineffective and water rights trading has been less active than expected. The Code's impact has been more negative at the level of river basins, where the institutional framework has revealed critical flaws in coordinating multiple water users and resolving conflicts. Against the Current: Privatization, Water Markets, and the State in Chile combines law, political economy, and geography to analyze the disadvantages, problems, and wider contexts of water markets. This book will appeal to everyone interested in property rights, market-friendly environmental policies, the political economy of sustainable development, and the intersection of economics with law and institutions.

Available in PDF, EPUB and Kindle. Book excerpt: Recent years have seen a major growth in the European law concerning the operation of the energy industry, especially with respect to electricity and gas. Several directives have been adopted that are aimed at the promotion of competition in this key sector of the European economy. At thesame time, the jurisprudence of the European Court had developed further on matters such as access to networks, import and export monopolies and security of supply. In this book the authors examine the principal legislation, Treaty provisions and decisions of the Court of Justice and Court of First Instance of the EU as they related to the promotion of competition in European energy markets. In particular, two chapters are devoted to a detailed analysis of theprovisions of the two directives that set out common rules for the creation of an internal market in the electricity and gas sectors. In each case, the analysis is set in the context of the various programmes of energy market liberalization and privatization in the Member States, which aresummarized in this book. However, the authors also take the wider pan-European context into account, explaining the requirements and the implications of the European Economic Area Agreement, the Energy Charter Treaty and the Europe Agreements with countries of Central and Eastern Europe. The approach adopted by the authors is both analytical and historical. They locate the legislation in the context of the EU Internal Market programme that began in the late 1980s and explain the roles played by the various parties (energy industries, consumers and EU institutions) in shaping thefinal legislation. Importantly, they explain how the framework character of the energy directives has led to further important rule-making in the implementation of the directives across the EU. They conclude that a co-ordinated response between the European Commission and the national regulatorswill be essential to resolve problems arising in the transition to a competitive energy market in the EU.

Available in PDF, EPUB and Kindle. Book excerpt: Focusing on five key themes - hydrocarbons, electricity, mining, social license to operate, and arbitration/dispute resolution- via in-depth country and regional case studies, this book seeks to capture the contrasting and sometimes conflicting trends in energy governance in Latin America as it wrestles with a dependence on fossil fuels whilst shifting toward a low carbon future. Energy transition continues to sit at the centre of the Latin American policy debate as the world continues to push for carbon neutrality by 2050. Latin America is undergoing a renewable energy transition, with substantial reserves (solar, wind, hydro, geothermal) and many countries in the region setting ambitious renewable energy policies, laws, and regulations to address climate change. However, recent initiatives to promote renewables must be placed in context. Historically, Latin America has developed and improved its economic and social standards due primarily to an economy based on the extractive industries and fossil fuels. This places renewables at the crossroads of multiple drivers, as the region seek to ensure security of supply, attract investment, and facilitate a low carbon energy transition.

Book excerpt: Though the modern Spanish State was formed in the mid Fifteenth Century, historical records show that water works, statues, and the utilization of water dates back to centuries BC. As a semi-arid country, the effort to control, store and assure water supplies to cities and fields is present in numerous historical and political landmarks.Water polic
