Sotto questo profilo, la presunzione, quale regola anticipata di giudizio, gioca un ruolo di primo piano, potendo fungere da veto player in grado di contrastare a monte il rischio di valutazioni giurisdizionali diversificate e talora troppo disinvolte. Il lavoro monografico trova, così, linfa vitale nello studio della fattispecie presuntiva sia da un punto di vista dogmatico, sia nei suoi risvolti pratici ed operativi all’interno del procedimento incidentale de libertate. Non senza uno sguardo “benevolmente” critico sugli scenari futuribili dischiusi dall’ultima riforma organica del sistema cautelare, approvata con legge 16 aprile 2015, n. 47. Proprio tale peculiare inclinazione speculativa rende l’opera fruibile al contempo dagli studiosi della materia processual-penalistica come pure dai professionisti del diritto. Sensibilizzando l’interprete alla tutela rafforzata delle prerogative difensive, quanto mai vulnerabili dinanzi a meccanismi semi-automatici di applicazione di misure cautelari.Federica Centorame ha conseguito il dottorato di ricerca in Diritto processuale penale interno, internazionale e comparato nell’Università degli Studi di Urbino. Collabora da diversi anni alle cattedre di diritto processuale penale e diritto penitenziario dell’Università degli Studi di Teramo. E’ autrice di svariate pubblicazioni, tra cui contributi in Volumi e articoli su riviste giuridiche, e relative ad aree di ricerca eterogenee ma tutte di particolare interesse e attualità per la giustizia penale processuale, quali indagini preliminari e garanzie difensive, preclusione endoprocedimentale, ne bis in idem europeo, misure cautelari e messa alla prova per adulti.

Part one provides a definition of the topics.
