Book excerpt: The late sixteenth-century penal debt bond, which allowed an unsatisfied creditor to seize the body of his debtor, set in motion a series of precedents that would shape the legal, philosophical, and moral issue of property-in-person in England and America for centuries. Focusing on this historical juncture at which debt litigation was not merely an aspect of society but seemed to engulf it completely, Of Bondage examines a culture that understood money and the body of the borrower as comparable forms of property that impinged on one another at the moment of default. Amanda Bailey shows that the early modern theater, itself dependent on debt bonds, was well positioned to stage the complex ethical issues raised by a system of forfeiture that registered as a bodily event. While plays about debt like The Merchant of Venice and The Custom of the Country did not use the language of political philosophy, they were artistically and financially invested in exploring freedom as a function of possession. By revealing dramatic literature's heretofore unacknowledged contribution to the developing narrative of possessed persons, Amanda Bailey not only deepens our understanding of creditor-debtor relations in the period but also sheds new light on the conceptual conditions for the institutions of indentured servitude and African slavery. Exemplary texts describe chaste women who kill their rapists, constant wives who make marriage a debilitating obligation, and devoted mothers who destroy the fitness of children. These cautionary tales draw attention to the more ordinary, necessary choices that take prescribed roles as a mandate for purposeful acts. For early modern narratives, writes Schwarz, intentional compliance poses a complex problem: it sustains crucial tenets of order and continuity but unsettles the hierarchical premises from which those tenets derive. Feminine will appears as a volatile force within heterosociality, lending contingent security to a system that depends less on enforced obedience than on contract and consent. The book begins with an examination of early modern disciplines that treat will as an aspect of the individual psyche, of rhetoric, and of sexual and gendered identities. Drawing on these readings, Schwarz turns to Shakespearean works in which feminine characters articulate and manage the values that define them, revealing the vital force of conventional acts. Her analysis engages with recent research that has challenged the premise of feminine subordination, both by identifying alternative positions and by illuminating resistance within repressive structures. Schwarz builds on this awareness of disparate modes and sites of action in formulating the book's central questions: With what agency, and to what effect, do feminine subjects inhabit the conventions of femininity? In what sense are authenticity and masquerade inseparable aspects of social performance? How might coercive systems produce effective actors? What possibilities emerge from the paradox of prescribed choice? Her conclusions have implications not only for early modern scholarship but also for histories of gender and sexuality, queer studies, and theories of the relationship between subjectivity and ideological constraint.

Book excerpt: The Early Years Single Funding Formula is intended to replace the different methods currently used to fund early years settings in the maintained sector and in the private, voluntary and independent (PVI) sector. Each local authority will in future use the same criteria for every setting in its area when allocating funds for education and care provided under the free entitlement for three and four year olds. But the Formula has resulted in winners and losers, and the greatest losers will be maintained nursery schools, which provide a quality of education and care which is very high and sets the standard for others to follow. Overall the difficulties encountered so far with the Single Funding Formula have arisen because of the way in which it has been implemented, rather than because of the concept. Local authorities were encouraged to offer settings a supplement to the basic hourly rate of funding to recognise high quality provision, but many have not done so. A quality supplement should be made mandatory. The Government was correct in deciding to defer full implementation until April 2011 and the year's delay must be used to restore stability and to rework funding formulae where necessary. Sir Jim Rose's proposals to encourage entry to primary school in the September following a child's fourth birthday will have far-reaching consequences for early years funding, but blur the distinction between early years and primary education. The Government should examine whether a unified funding system should be introduced for all children aged from 2 to 11 years old.

Brexit supporters’ frequent targeting of European Union (EU) movers, especially those from Central and Eastern Europe, has been popularly assumed as at odds with the EU project’s foundations based on equality and inclusion. This book dispels that notion. By interrogating the history, wording, omissions, assumptions and applications of laws, policies and discourses pertinent to mobility and equality, the argument developed throughout the book is that the parameters of CEE nationals’ status within the EU have been closely circumscribed, in line with the entrenched historical positioning of the west as superior to the east. Engaging current legal, economic, political and moral issues--against the backdrop of Brexit and contestations over EU integration and globalisation--this work opens avenues of thought to better understand law’s role in producing and sustaining social stratifications.
