Para tanto, inicialmente é realizado um exame da evolução do Estado e a redefinição de suas funções e suas formas de relacionamento com os particulares. O estudo pretende ainda demonstrar a importância das políticas públicas para o Estado e o Direito, estabelecendo suas características normativas, colocando-as como objeto do Direito Administrativo e ressaltando sua importância como instrumento de governança. Visa-se, assim, a uma análise sistêmica de um dos principais mecanismos de atuação da Administração Pública, de forma a associar à realização do interesse público. Além disso, busca fornecer subsídios para que corretamente se compreenda o conceito de interesse público, relacionando-o com os direitos fundamentais. Por fim, objetiva demonstrar que a eleição dos direitos que serão realizados pela Administração Pública não se encontra exclusivamente no campo da deliberação política, visto que também está submetida aos comandos constitucionais.

The Brazilian Constitution of 1988 represents an institutional framework able to restructure the relationship between the powers after the military dictatorship. The constituents drafted the Brazilian Constitution in order to set an extensive system of judicial protection for fundamental rights, by means of several instruments that have strengthened access to the Judiciary. Because the Brazilian Constitution has an extensive list of fundamental rights, the STF was called to interpret them several times and it developed an unwritten understanding of these fundamental rights. These decisions are not available to the international community since they are not translated to English. Based on this gap, this original book illustrates the main rulings on human rights analyzed by great scholars in Brazil. The text presents a deep discussion regarding the characteristics of the cases and demonstrates how the STF has built the legal arguments to interpret the extension of the fundamental rights.

The Court is uniquely positioned to enhance or inhibit political reform, enshrine or dismantle social inequalities, and expand or suppress individual rights. Yet despite claims of victory from judicial activists and complaints of undemocratic lawmaking from the Court's critics, numerous studies of the Court assert that it wields little real power. This book examines the nature of Supreme Court power by identifying conditions under which the Court is successful at altering the behavior of state and private actors. Employing a series of longitudinal studies that use quantitative measures of behavior outcomes across a wide range of issue areas, it develops and supports a new theory of Supreme Court power. Matthew E. K. Hall finds that the Court tends to exercise power successfully when lower courts can directly implement its rulings; however, when the Court must rely on non-court actors to implement its decisions, its success depends on the popularity of those decisions. Overall, this theory depicts the Court as a powerful institution, capable of exerting significant influence over social change.
