Book excerpt: Upon achieving independence from Great Britain in 1948, the stunningly beautiful island of Ceylon, re-named Sri Lanka in 1972, was expected to become a sort of 'South Asian Singapore'. However, stable political order and bright economic prospects proved insufficient to maintain peace. A host of unsolved ethnic conflicts and social inequalities conspired to erupt into an armed conflict in 1971. By 1987, the crisis heated up to the point where the government in New Delhi began exercising fierce pressure upon the Sri Lankan government and the Sri Lankan Tamil insurgents to arrive at a peace deal. In order to help maintain peace, the Indian Peace Keeping Force was deployed on the island. However, with a few weeks, the troops of the Indian Army found themselves involved in a bloody and protracted confrontation with the most powerful of Tamil insurgent movements - the Liberation Tamil Tigers of Elam (LTTE). The peacekeeping operation was thus quickly converted into a military intervention and a bloody quagmire. To make matters even more complex, southern Sir Lanka meanwhile became engulfed in an unprecedented wave of public violence, triggered by the second insurrection of Sinhalese ultra-leftist movement, the JVP. Calling upon extensive studies of the Sri Lankan War, with the help of first hand sources, official documentation and publications from all of the involved parties, this volume provides an in-depth and particularly detailed account of military operations between 1987 and 1990. It is illustrated by over 120 photographs, maps and 12 color profiles.

There is a great deal of uncertainty about how effective investment treaty protections are in volatile times, how they relate to other applicable legal frameworks, and how they affect the state security policy and the post-conflict transition to peace. This book explores how foreign investment is protected in times of armed conflict under the investment treaty regime. It does so by combining insights from different areas of international law, including international investment law, international humanitarian law, international human rights law, the law of state responsibility, and the law of treaties. While the protections have evolved over time, with the investment treaty regime providing the strongest legal framework for protecting investors yet, there has been an apparent shift in treaty practice towards safeguarding a state's security interests. Jure Zrilic identifies and analyses the flaws in the existent normative framework, but also highlights the potential that investment treaties have for minimising the devastating effects of armed conflict. The book offers an analytical framework for assessing the investment treaty regime in times of armed conflict, distinguishing between different paradigms and different types of conflicts. The Western public tends to assume that the doctrinal rejection of violence in Buddhism would make Buddhist pacifists, and often expects Buddhist societies or individual Asian Buddhists to conform to the modern Western standards of ‘peaceful’ behavior. This stereotype – which may well be termed ‘positive Orientalism,’ since it is based on assumption that an ‘Oriental’ religion would be more faithful to its original non-violent teachings than Western Christianity – has been periodically challenged by enthusiastic acquiescence by monastic Buddhism to the most brutal sorts of warfare. This volume demolishes this stereotype, and produces instead a coherent, nuanced account on the modern Buddhist attitudes towards violence and warfare, which take into consideration both doctrinal logic of Buddhism and the socio-political situation in Asian Buddhist societies.
