Available in PDF, EPUB and Kindle. Book excerpt: Anthology from the year 2014 in the subject Law - European and International Law, Intellectual Properties, , language: English, abstract: Chemicals legislation is quite a vivid regulatory arena. As is the case in the science of Chemistry itself there is also no standstill in chemicals legislation. Most of the relevant regulations are subject to chronic revisions. In order to keep up with the actual legislation beyond the efforts of a looseleaf- collection the series CSL: Consolidated Substances Legislation has been created. It offers a firm outline regarding the different fields of substances legislation (besides the general substances legislation like REACH also cosmetics legislation, etc.) and provides users with the relevant legislative texts in an actual and consolidated manner. I.e. starting from the original regulation all modifications can be found at their respective position within the legal text. Therefore, the need for a detailed compilation of each and any corrigendum, amendment and adaptation to the technical progress can be reduced to a minimum. The area of substances legislation is both a fascinating and demanding legal field that can hardly be compared to any other, as its regulations create direct effects on everyone. The series CSL offers a new access to its origins.

Book excerpt: Regulation (EC) 1107/2009 lays down the main instruments for placing effective plant protection products (using pesticide substances) on the market that are safe for humans, animals and the environment, while at the same time ensuring effective functioning of the internal market and improved agricultural production. This European Implementation Assessment found that the above objectives, while largely relevant to real needs, are not being achieved in practice. In particular, implementation of the main instruments of the regulation – substance approval, plant protection products authorisation and enforcement of the regulatory decisions taken in the frame of the approvals and authorisations, is problematic, which also affect other related EU policies. Nevertheless, despite the implementation challenges observed, stakeholders – including national competent authorities, health/environment NGOs, manufacturers of substances and plant protection products and their users (farmers) – agree that the EU is the appropriate level at which regulatory action in the field of pesticides (used in plant protection products) should continue to take place.

This book was released on 2018 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The "Study supporting the REFIT Evaluation of the EU legislation on plant protection products and pesticides residues" provides an analysis of the legislative framework for pesticides. It covers two Regulations: Regulation (EC) No 1107/2009 on the placing of plant protection products on the market, and Regulation (EC) No 396/2005 on pesticide residues in food and feed. The study assesses the effectiveness, efficiency, relevance, coherence, and the EU added value of these Regulations. The analysis is based on case studies and on extensive consultation which encompassed interviews, focus groups, workshops, and surveys. Almost 10,000 citizens participated in an Open Public Consultation. The study finds that the two Regulations are overall effective and relevant. The Regulations allow a higher level of harmonisation across MSs that enhances the functioning of the internal market and protection of the health of consumers. Still, there is room to improve. The complexity of the issues at hand adds to the challenges of harmonisation, coordination, and implementation. These difficulties create obstacles to the full functioning of the internal market and protecting the health of humans, animals, and the environment.

Book excerpt: This report provides an overview about the functioning of the EU Plant Protection Product authorisation process in several EU Member States and if it is in line with requirements laid down in Regulation (EC) No 1107/2009. The purpose of this regulation is to ensure a high level of protection of both human and animal health and the environment. It sets out the requirements, procedure and timeframes for authorisation of Plant Protection Products and established a zonal system of authorisation in the EU to enable a harmonised and efficient system to operate. The report finds that the zonal system laid down in the Regulation is not working effectively and deadlines for authorisation are not met by the majority of Member States as they do not avail of the opportunities to share work among them and they have not taken measures to compensate this lack of work sharing. As a result, the objective of the Regulation to ensure a high level of protection of both human and animal health and the environment and to improve the functioning of the internal market in the Member States is undermined.

Book excerpt: This brief presents a view, based on evidence, that on balance, the impact of Regulation (EC) No 1107/2009 on innovation and development of alternatives and new PPPs has been negative. It outlines the current process leading from the submission of the registration dossier to the authorisation of plant protection products (PPPs), and describes how various technical and regulatory issues cause costly delays and discourage investment in research and development (R & D) of new PPPs. Finally, the brief concludes with a number of recommendations for consideration.

The survey aims at authorities in EU Member States in charge of implementing the provisions of Regulation (EC) No 396/2005 on maximum residue levels of pesticides (MRL Regulation) and Regulation (EC) No 1107/2009 concerning the placing of plant protection products on the market (PPP Regulation). The feedback from the competent authorities will be of importance in the ongoing REFIT evaluation of the two Regulations. In particular, the survey seeks to collect information on how well the rules governing the approval of active substances, authorisation of plant protection products and the setting of MRLs in the EU work in practice. The survey aims at identifying strengths and weaknesses of the Regulations and gathers information on how the situation has changed after the entry into force of the Regulations.

Book excerpt: This book explores the regulation of pesticides in the European Union in order to reveal the complex, controversial, and contested nature of an assessment system proudly declared by the EU to be ‘the strictest in the world’. The current regulatory framework is based on Regulation 1107/2009, which substantially reformed the previous system. The analysis describes the new criteria and procedures for the authorization of active substances to be used in the production of pesticides, traces the lengthy policy formulation process, and identifies factors that made policy change possible. Further, the book illustrates the current controversies that characterise the implementation of Regulation 1107/2009: the ban of pesticides harmful to pollinators, the renewal of the authorization of glyphosate, and the definition of criteria for the assessment of endocrine disruption. The author provides information on policy outcomes and highlights persisting shortcomings in the enforcement of EU regulation. This book will appeal to students and scholars from a variety of disciplines, including political science, political sociology, and public policy.

This book was released on 2015 with total page 21 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report provides an overview of the outcome of a series of audits carried out by the Food and Veterinary Office (FVO) in 19 Member States (MSs) of the European Union (EU) between January 2012 and June 2014. This was the fourth series of FVO audits in this area. The objective of the audits was to evaluate the control systems in place for pesticides, in particular, the implementation of requirements for the authorisation of plant protection products (PPPs) and official controls on the marketing and use of PPPs under Regulation (EC) No 1107/2009 and Directive 2009/128/EC, and the implementation of the requirements for official controls of PPPs at growers, as specified in Regulation (EC) No 882/2004.^While there were systems and procedures for the authorisation of PPPs in place in all Member States, related shortcomings were identified in two areas: (a) Delays with re-authorisations of PPPs under Directive 91/414/EEC, and with mutual recognitions under Regulation (EC) No 1107/2009: Many authorised PPP had not been evaluated to EU standards, more than 15 years after the principles for evaluation had been established. Similarly, delays and problems with cooperation between Member States were identified for the zonal authorisation system under Regulation (EC) No 1107/2009. This highlights the difficulty of MSs to implement authorisation systems based on EU legislation; (b) Emergency authorisations of PPPs under Regulation (EC) No 1107/2009: The report identifies problems with misuse of emergency authorisations for minor uses of PPPs, but also for other use extensions of approved PPPs.^In addition, emergency authorisations for the same products have been granted for consecutive years, thus undermining the effectiveness of the strict criteria for regular authorisations established by EU legislation. Systems were in place for official controls on the marketing and use of PPPs. One common weakness in controls at both market and user level, was the coverage of operators. With regard to official controls on the marketing of PPPs, there were further weaknesses related to unsatisfactory labelling checks and unsatisfactory quality controls of pesticides. As a consequence, there was insufficient assurance that counterfeit and illegal pesticides would be detected. In general, official controls on the use of PPPs were more effective than controls on the marketing of PPPs.^In most of the MSs visited, all relevant aspects were covered during inspections and comprehensive checks of records kept by professional users were taking place, which provided guarantees that PPPs are applied in accordance with the conditions specified on the labels. Weaknesses were identified with regard to prioritisation of official controls. Co-ordination and co-operation between and, in some cases, within CAs was considered to be weak. Initial measures were adequately put into place for the implementation of Directive 2009/128/EC, in particular, training and certification of professional users, safe handling and storage of PPPs, their containers and remnants, Integrated Pest Management (IPM) and application equipment. This is a step forward to ensure the sustainable use of pesticides. Good practices were found with regard to systems for official controls as a whole, or certain aspects. These are described in the relevant chapters of the report.
