Sul piano giuridico Stato, Regioni ed Enti locali, ciascuno nell’ambito delle proprie competenze, devono rimodellare i propri interventi in materia urbanistica ed edilizia, riconsiderando il correlativo esercizio del potere di pianificazione sul proprio territorio in funzione dello sviluppo complessivo ed armonico del territorio stesso. L’esercizio dei poteri di pianificazione territoriale deve valorizzare le esigenze legate alla tutela di interessi costituzionalmente primari, tra i quali rientrano la tutela del paesaggio e del patrimonio storico e artistico, nonché la tutela dell’ambiente, la biodiversità e gli ecosistemi, indicati dall’art. 9 della Costituzione. Il volume è quindi diretto ad esaminare la complessa connessione tra la normativa ambientale, che è tuttora in rapida evoluzione, e quella che disciplina la pianificazione urbanistica e l’edilizia e come quest’ultima possa - ed in quale misura - essere condizionata dalla prima. In particolare i singoli Autori dell’opera delineano, con sintesi approfondita, il quadro normativo generale; i vincoli normativi apposti dalla tutela paesaggistica; le procedure di valutazione di impatto ambientale e di valutazione ambientale strategica; il disegno normativo di difesa del suolo e di prevenzione dell’inquinamento; l’invarianza idraulica e la più recente tematica delle energie rinnovabili.
