Available in PDF, EPUB and Kindle. Book excerpt: Composite administrative procedures are procedures in which administrative authorities from the Union and from Member States cooperate and each provide a relevant input into the final administrative decision taken at the Union or the national level. these procedures are becoming more and more frequent as a mechanism for the implementation of Union policies and they reflect a multi-layered system of EU and national administrative cooperation that goes beyond the old paradigm of the indirect implementation of EU Law. Nevertheless, they remain a relatively unexplored topic in European Administrative Law. However positive they may be for building networks of mutual trust between the Union and national administrative actors, and however efficient for the adoption of technically complete and consensual decisions, they raise many legal concerns. After defining these procedures and placing them in context, this ook goes on to identify the legal shortcomings to which they give rise from the perspective of the individual and points towards potential solutions. Composite procedures reflect very well the current state-of-play of European integration with regard to Administrative Law, but the European citizen should not suffer in his legal position owing to their complexit.

Book Synopsis EU Administrative Law by : Paul Craig
Download or read book EU Administrative Law written by Paul Craig and published by Oxford University Press. This book was released on 2018-10-25 with total page 994 pages. Available in PDF, EPUB and Kindle. Book excerpt: The third edition of EU Administrative Law provides comprehensive coverage of the administrative system in the EU and the principles of judicial review that apply in this area. This revised edition provides important updates on each area covered, including new case law; institutional developments; and EU legislation. These changes are located within the framework of broader developments in the EU. The chapters in the first half of the book deal with all the principal variants of the EU administrative regime. Thus there are chapters dealing with the history and taxonomy of the EU administrative regime; direct administration; shared administration; comitology; agencies; social partners; and the open method of coordination. The coverage throughout focuses on the legal regime that governs the particular form of administration and broader issues of accountability, drawing on literature from political science as well as law. The focus in the second part of the book shifts to judicial review. There are detailed chapters covering all principles of judicial review and the discussion of the law throughout is analytical and contextual. It begins with the principles that have informed the development of EU judicial review. This is followed by a chapter dealing with the judicial system and the way in which reform could impact on the subject matter of the book. There are then chapters dealing with competence; access; transparency; process; law, fact and discretion; rights; equality; legitimate expectations; two chapters on proportionality; the precautionary principle; two chapters on remedies; and the Ombudsman.
Book Synopsis Federalism and the European Union by : Michael Burgess
Download or read book Federalism and the European Union written by Michael Burgess and published by Routledge. This book was released on 2002-09-11 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: A revisionist interpretation of the post-war evolution of European integration and the European Union (EU), this book reappraises and reassesses conventional explanations of European integration. It adopts a federalist approach which supplements state-based arguments with federal political ideas, influences and strategies. By exploring the philosophical and historical origins of federal ideas and tracing their influence throughout the whole of the EU's evolution, the book makes a significant contribution to the scholarly debate about the nature and development of the EU. The book looks at federal ideas stretching back to the sixteenth century and demonstrates their fundamental continuity to contemporary European integration. It situates these ideas in the broad context of post-war western Europe and underlines their practical relevance in the activities of Jean Monnet and Altiero Spinelli. Post-war empirical developments are explored from a federalist perspective, revealing an enduring persistence of federal ideas which have been either ignored or overlooked in conventional interpretations. The book challenges traditional conceptions of the post-war and contemporary evolution of the EU, to reassert and reinstate federalism in theory and practice at the very core of European integration.

Book Synopsis Approaching the EUropean Federation? by : Professor Søren Dosenrode
Download or read book Approaching the EUropean Federation? written by Professor Søren Dosenrode and published by Ashgate Publishing, Ltd.. This book was released on 2013-03-28 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European project has, within only 52 years, achieved a surprising momentum, and the European Union is now approaching full statehood. The Convention on the Future of Europe has finished its work and handed over a proposal for a constitutional treaty to the Heads of State and Government of the EU. It is therefore the ideal time to present an integrated analysis of what appears to be the emerging European State. This key volume therefore discusses the central questions and concepts within the field of European studies, which include federalism, the relationship between statehood and constitution, integration and constitution, the regions in the 'new' Europe and the EU as an international actor. These discussions are then developed and analyzed in relation to the draft constitution. Timely and insightful, the volume is suitable for courses on European integration, federalism and international politics.
Book Synopsis Law and New Governance in the EU and the US by : Gráinne de Búrca
Download or read book Law and New Governance in the EU and the US written by Gráinne de Búrca and published by Bloomsbury Publishing. This book was released on 2006-04-26 with total page 444 pages. Available in PDF, EPUB and Kindle. Book excerpt: New approaches to governance have attracted significant scholarly attention in recent years. Commentators on both sides of the Atlantic have identified, charted and evaluated the rise and spread of forms of governance, forms which seem to differ from previous regulatory and legal paradigms. In Europe, the emergence of the Open Method of Coordination has provided a focal point for new governance studies. In the US, scholarship on issues such as collaborative problem-solving, democratic experimentalism, and problem-solving courts exemplify the interest in similar developments. This book covers diverse policy sectors and subjects, including the environment, education, anti-discrimination, food safety and many others. While some chapters concentrate on the operation of new governance mechanisms in a federal and multilevel context and others look at the relationship between public and private mechanisms and settings, what all the contributors share in common is the pursuit of effective mechanisms for addressing complex social problems, and the challenges they raise for our understanding of law and constitutionalism, and of legal and constitutional values.
