La dificultad radica, esencialmente, en el carácter progresivo de la capacidad del menor y, en muchas ocasiones, no absolutamente homogéneo de unos menores a otros. El debate científico y jurídico sobre optar por un criterio objetivo (edad) o subjetivo (madurez) no está cerrado aún, pese a que viene planteándose desde hace ya varias décadas. Además, en la resolución de tales conflictos surgen diferentes dudas y problemas, no sólo derivados de la complejidad de operar con principios jurídicos algo difusos como es el del interés superior del menor, o por el papel que en la toma de decisiones debe otorgarse a los padres, sino, sobre todo, por las nuevas evidencias científicas que surgen al amparo del avance de los estudios de imagen del cerebro, a través, entre otras, de la neurología de la conducta que ponen en duda el paradigma ofrecido por la psicología evolutiva con el que hemos venido operando tradicionalmente en el campo jurídico. En definitiva, esta obra pretende abordar de una manera completa, sistemática, práctica y, sobre todo, actualizada la capacidad de obrar de los menores en el ámbito del tratamiento médico. Se trata de un trabajo que puede ser de interés y utilidad no sólo para juristas sino también para aquellos que trabajan con menores en el ámbito sanitario o campos similares o que tengan interés en aproximarse a la capacidad de obrar del menor desde ramas del conocimiento no estrictamente jurídicas.

As they point out, xenotransplantation represents a major deviation from standard medical practice and the possibility of transplantation of large segments of tissue, or whole organs, from animals into humans poses an entirely novel set of considerations - ethical, legal and scientific - which it is necessary to evaluate and understand.
