Book excerpt: Regulatory Impact Assessments (RIAs) are designed to enable policy makers to assess the need for, and impact of, new regulations. In 2005 Government departments produced around 200 'Final' RIAs. They have been used to assess the likely economic, social and environmental impacts of the proposed regulation, and the range of options for implementing it. They have grown in scope in recent years as additional assessment criteria, such as sustainable development, have been added. Departments have primary responsibility for undertaking RIAs, and the Better Regulation Executive (BRE), which forms part of the Cabinet Office, has primary responsibility for taking forward the Government's Better Regulation agenda. The National Audit Office focused its examination on four departments - Culture, Media and Sport (DCMS); Trade and Industry; Home Office; and Transport (DfT). RIAs are often not used in the right way. The purpose of RIAs is not always understood; there is a lack of clarity in the presentation of the analysis; and persistent weaknesses in the assessments. RIAs are only occasionally used to challenge the need for regulation and influence policy decisions. If used well, RIAs can offer an effective tool for assessing different options and identifying regulatory solutions that do not impose unnecessary costs on those being regulated. There are three ways the BRE should bolster RIAs. Firstly, it should re-emphasise that economics should lie at the heart of RIAs, considering market failure, counterfactuals, competition, and how consumers and organisations behave. Secondly, RIAs need to be supplemented by a broader toolkit that policy makers can use earlier in the life of a policy. Thirdly, the BRE could re-emphasise the importance of the RIA process in challenging the introduction of new regulations.

Book excerpt: The European Communities adopted the Nitrates Directive on 12 December 1991 with the objective of reducing water pollution caused or induced by nitrates from agricultural sources and preventing further such pollution. It requires member states to designate as Nitrate Vulnerable Zones areas of land that drain into polluted waters and to set up action programmes in these zones. Nitrate pollution can also increase eutrophication, reduce biodiversity and affect the recreational value of water. The Department for Environment, Food and Rural Affairs (Defra) estimates that the cost of treating nitrates in drinking water between 2005 and 2010 will be £288 million in capital expenditure and £6 million a year in operating costs. Defra issued a consultation document on the Directive in 2007, and its proposed changes reflect the fact that the European Commission does not think the Directive was properly implemented in England. The proposals would have a significant impact on some 195,500 farmers in the affected areas, requiring them to alter practices for storing and spreading livestock manure and for applying chemical fertiliser. The Committee finds insufficient evidence to assess how effective the current action programme has been in reducing nitrate pollution in England. It welcomes some of Defra's proposals but has concerns about others. The proposed new action plan will place a considerable financial burden on livestock and dairy farmers, and Defra should make representations to the Treasury on the need for support in the form of tax relief for the construction of slurry storage facilities.

The Committee's report examines the European Commission's proposal to introduce a Regulation (the Clinical Trials Directive) on medicinal products for paediatric use which aims to stimulate the development of medicines for children and lay down rules for testing and approval. Issues discussed include: the need for better regulation of paediatric medicines; the ethical considerations involved in clinical trials on children, including the issue of consent; mechanisms for implementing the Regulation; access to the database of information on clinical trials; the rewards and incentives proposed to stimulate the research and development of medicines; and the legal basis for the regulation under the EC Treaty. The Committee's report recognises the urgent need for effective action at the European level to authorise medicines for paediatric use and gives broad support to the proposed Directive. However, a number of key issues are highlighted, including: the need for improved labelling of medicines; that the guidelines underpinning the Directive should take account of ethical considerations involved to ensure the rights and capacity of children to give informed consent to trials; and concerns are raised about the adequacy of proposed incentive mechanisms.
