Under the dynamics of global change, megacities are themselves changing: On the one hand they are prone to increasing socio-economic vulnerability due to pronounced poverty, socio-spatial and political fragmentation, sometimes with extreme forms of segregation, disparities and conflicts. On the other hand megacities offer positive potential for global transformation, e.g. minimisation of space consumption, highly effective use of resources, efficient disaster prevention and health care options – if good strategies were developed. At present in many megacities and urban areas of the developing world and the emerging economies the quality of life is eroding. Most of the megacities have grown to unprecedented size, and the pace of urbanisation has far exceeded the growth of the necessary infrastructure and services. As a result, an increasing number of urban dwellers are left without access to basic amenities like clean drinking water, fresh air and safe food. Additionally, social inequalities lead to subsequent and significant intra-urban health inequalities and unbalanced disease burdens that can trigger conflict and violence between subpopulations. The guiding idea of our book lies in a multi- and interdisciplinary approach to the complex topic of megacities and urban health that can only be adequately understood when different disciplines share their knowledge and methodological tools to work together. This book explores the multiple legal grounds of Meiji Japan's assertion of sovereign statehood within that order: natural law, treaty law, international administrative law, and the laws of war. Contrary to arguments that Japan was victimized by 'unequal' treaties, or that Japan was required to meet a 'standard of civilization' before it could participate in international society, Howland argues that the Westernizing Japanese state was a player from the start. In the midst of contradictions between law and imperialism, Japan expressed state will and legal acumen as an equal of the Western powers – international incidents in Japanese waters, disputes with foreign powers on Japanese territory, and the prosecution of interstate war. As a member of international administrative unions, Japan worked with fellow members to manage technical systems such as the telegraph and the post. As a member of organizations such as the International Law Association and as a leader at the Hague Peace Conferences, Japan helped to expand international law. By 1907, Japan was the first non-western state to join the ranks of the great powers.

How are activists changed and movements transformed when they reach out to others a world away? This adept study addresses these questions by tying together local, national, regional, and global historical narratives surrounding the contemporary Japanese environmental movement. Spanning the era of Japanese industrial pollution in the 1960s and the more recent rise of movements addressing global environmental problems, it shows how Japanese activists influenced approaches to environmentalism and industrial pollution in the Asia-Pacific region, North America, and Europe, as well as landmark United Nations conferences in 1972 and 1992. Japan’s experiences with diseases caused by industrial pollution produced a potent “environmental injustice paradigm” that fueled domestic protest and became the motivation for Japanese groups’ activism abroad. From the late 1960s onward Japanese activists organized transnational movements addressing mercury contamination in Europe and North America, industrial pollution throughout East Asia, radioactive waste disposal in the Pacific, and global climate change. In all cases, they advocated strongly for the rights of pollution victims and people living in marginalized communities and nations—a position that often put them at odds with those advocating for the global environment over local or national rights. Transnational involvement profoundly challenged Japanese groups’ understanding of and approach to activism. Numerous case studies demonstrate how border-crossing efforts undermined deeply engrained notions of victimhood in the domestic movement and nurtured a more self-reflexive and multidimensional approach to environmental problems and social activism. Price control and its limits are issues that affect all liberal market economies, as well as more regulated markets. For the past several years, courts in many different countries have been confronted with the issue of whether, and to what extent, they should intervene regarding price-related terms in standard form contracts – especially in the area of consumer contracts. Open price clauses, flat remunerations, price adjustment clauses, clauses giving the seller/supplier the right to ask for additional payments, bundling or partitioning practices, etc.: a variety of price related terms are used to manipulate customers’ choices, often also by exploiting their behavioral biases. The result is an unfavorable contract that is later challenged in court. However, invalidating a given price term in standard forms e.g. of a banking or utilities contract only has an inter partes effect, which means that in thousands if not millions of similar contracts, the same clauses continue to be used. Effective procedural rules are often lacking. Therefore, pricing patterns that serve to hide rather than to reveal the real cost of goods and services require special attention on the part of regulators. The aim of this book is to determine the various approaches in the world regarding price term control, and particularly to discuss the efficiency of both paths, ex ante regulatory and ex post judicial intervention. Thanks to its broad comparative analysis, this book offers a thorough overview of the methods employed in several countries. It gathers twenty-eight contributions from national rapporteurs and one supra-national rapporteur (EU) to the 2018 IACL Congress held in Fukuoka.
