This Instruction contains directions for identifying and inspecting workplaces where workers are likely to be exposed to hexavalent chromium and the other toxic substances, as well as relevant procedures and plans for compliance assistance. This NEP supersedes all existing Regional and Local Emphasis Programs specifically addressing hexavalent chromium. This Instruction includes the following key elements: Information for selecting sites for inspection, including a list of Standard Industrial Classification (SIC) and North American Industrial Classification System (NAICS) codes for industries known to have overexposures to hexavalent chromium; Procedures for conducting thorough inspections with an emphasis on industrial hygiene evaluations; Measures to be taken to ensure the safety and health of OSHA compliance staff while conducting inspections under this Instruction; Program evaluation procedures designed to ensure that the goals of this NEP are measured as accurately as possible. The procedures require Area Offices to conduct follow-up inspections in certain cases, including where overexposures to hexavalent chromium or the other toxic substances targeted by this NEP are cited; and, Plans for outreach to train OSHA compliance staff and the general public on the hazards addressed by this NEP, as well as effective methods for abating those hazards.

Several employees from this facility were diagnosed with bronchiolitis obliterans, a severe obstructive lung disease. Following this investigation and the evaluation of lung function tests and air sampling results, NIOSH determined that inhalation exposure to butter-flavoring chemicals presents a risk for occupational lung disease. In April 2007, the Centers for Disease Control and Prevention (CDC) reported in its Morbidity and Mortality Weekly Report (MMWR) seven additional cases of bronchiolitis obliterans in employees working in facilities where flavorings were manufactured. This instruction establishes an NEP to identify and reduce or eliminate hazards associated with employee exposure to flavoring chemicals in facilities that manufacture food flavorings containing diacetyl. Diacetyl is one of the most common compounds found during investigations of microwave popcorn and flavoring manufacturing facilities. This NEP provides guidance on targeting, inspection procedures, engineering controls, work practice controls, and compliance assistance.

All three standards were effective May 30, 2006. Employers with 20 or more employees were allowed six months, until a start-up date of November 27, 2006, to come into compliance with most of the provisions of the standards. Employers with 19 or fewer employees were allowed 12 months, until a start-up date of May 30, 2007, to come into compliance with most of the provisions. All employers were allowed four years from the effective date, a deadline of May 31, 2010, to install feasible engineering controls. The general industry standard, 29 CFR 1910.1026, also includes an appended settlement agreement with the Surface Finishing Industry Council (SFIC). This new Directive provides policy and guidance for enforcement of all three Cr(VI) standards, and implementation of these enforcement procedures shall begin on the effective date of this Directive. Special policies are also provided for enforcement until May 31, 2010, when employers must comply with requirements for feasible engineering and work practice controls. The new Cr(VI) standards have lowered the permissible exposure limit (PEL) to 5 g/m3 and established an action level of 2.5 g/m3.

Criteria documents contain a critical review of the scientific and technical information about the prevalence of hazards, the existence of safety and health risks, and the adequacy of control methods. By means of criteria documents, NIOSH communicates these recommended standards to regulatory agencies, including the Occupational Safety and Health Administration (OSHA), health professionals in academic institutions, industry, organized labor, public interest groups, and others in the occupational safety and health community. This criteria document is derived from the NIOSH evaluation of critical health effects studies of occupational exposure to hexavalent chromium (Cr[VI]) compounds. It provides recommendations for controlling workplace exposures including a revised recommended exposure limit (REL) derived using current quantitative risk assessment methodology on human health effects data. Cr(VI) compounds include a large group of chemicals with varying chemical properties, uses, and workplace exposures. Their properties include corrosion-resistance, durability, and hardness. Sodium dichromate is the most common chromium chemical from which other Cr(VI) compounds may be produced. Materials containing Cr(VI) include various paint and primer pigments, graphic art supplies, fungicides, corrosion inhibitors, and wood preservatives. Some of the industries in which the largest numbers of workers are exposed to high concentrations of Cr(VI) compounds include electroplating, welding, and painting. An estimated 558,000 U.S. workers are exposed to airborne Cr(VI) compounds in the workplace.

Keeping health care workers healthy is an ethical commitment both in terms of addressing the occupational risks faced by health care workers and of providing for the continuity of patient care and services needed to maintain the health of individuals and communities. During a public health emergency, challenges will arise concerning the availability of respiratory protective devices (i.e., respirators). Reusable respirators (specifically, reusable half-facepiece elastomeric respirators) are the standard respiratory protection device used in many industries, and they provide an option for use in health care that has to date not been fully explored. The durability and reusability of elastomeric respirators make them desirable for stockpiling for emergencies, where the need for large volumes of respirators can be anticipated. However, they are used infrequently in health care. Reusable Elastomeric Respirators in Health Care explores the potential for the use of elastomeric respirators in the U.S. health care system with a focus on the economic, policy, and implementation challenges and opportunities. This report examines the practicability of elastomeric use in health care on a routine basis and during an influenza pandemic or other large aerosol-transmissible outbreak, when demand for respiratory protective devices by U.S. health care personnel may be larger than domestic supplies. The report also addresses the issues regarding emergency stockpile management of elastomeric respiratory protective devices.
