Notevoli, per quantità ed importanza, sono le innovazioni che negli ultimi cinque anni hanno riguardato questo settore dell'ordinamento: si possono ricordare, oltre alle sentenze della Corte costituzionale che hanno dichiarato l'illegittimità di talune disposizioni della legge penitenziaria (valga, per tutte, la sent. cost. 341/ 2006, in tema di lavoro carcerario), gli interventi legislativi mediante i quali si è voluto, per un verso, rafforzare il regime c.d. di carcere duro (l. 15 luglio 2009, n. 94) e si è tentato, per un altro verso, di porre un argine alla piaga del sovraffollamento carcerario (l. 26 novembre 2010, n. 199) nonché di ridurre al minimo la presenza dietro "le sbarre" dei figli delle condannate-madri (l. 21 aprile 2011, n.62). Non solo: vengono attentamente monitorate sia le più importanti circolari emanate dai vertici dell'Amministrazione penitenziaria sia, in un'ottica grandangolare dalla quale sarebbe anacronistico prescindere, le sempre più numerose pronunce della Corte europea dei diritti dell'uomo, relative alle tematiche penitenziarie. Risulta ulteriormente arricchita la già copiosa Appendice, nella quale è stato inserito il testo della Raccomandazione R(2010)1, recante le «Regole europee sulla messa alla prova». STRUTTURA L'opera, divisa in due tomi, è strutturata secondo la classica formula del commentario articolo per articolo e i commenti alle novità normative indicate vengono svolti negli articoli del Testo Unico sull'Ordinamento penitenziario e delle norme del codice di procedura penale. Un'ampia Appendice arricchisce e completa l'opera. Contiene: - il Testo unico sull'immigrazione - la legge sull' "indultino' - il Regolamento esecutivo del 2000 - alcune Raccomandazioni europee di cui una del 2006 Risulta ulteriormente arricchita la già copiosa appendice con l'inserimento della Raccomandazione R(2010)1, recante le «Regole europee sulla messa alla prova». Indice sommario e indice analitico utilissimi per facilitare il reperimento degli argomenti in così tante fonti normative.

Book excerpt: As a part of the debate on penitentiary architecture, this book proposes a critical interpretation of the conceptual elements and design approaches involved. This proposal, more than others, may “mend” the relationship between theoretical conception and the actual building practice for a prison. The interpretation is developed from the idea that the architectural project, when it materialises in a built structure, is always the material expression of an abstract idea and of a specific vision of the world which manifests itself through the architectural consistency of the building and of the built spaces. The text presented here focuses on the creation of organisational-functional tools for open-regime minimum security structures and on the identification of architectural solutions in which the residential and domestic features of the structures prevail over the typological and distributive layouts typical of traditional penitentiary buildings. The analysis aims at identifying the main essential principles for an efficient design, such as: the location, size, spatial organisation, typology of housing space, and last but not less important, the rationalisation of the internal flows. The key elements identified are summarised into a series of general design criteria aimed at establishing an efficient relationship between the functional model and the typological structure, as well as between the building and the surrounding urban fabric.

Book excerpt: From the tone of the report by the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Re search, one might conclude that the whole-brain-oriented definition of death is now firmly established as an enduring element of public policy. In that report, Defining Death: Medical, Legal and Ethical Issues in the Determination of Death, the President's Commission forwarded a uni form determination of death act, which laid heavy accent on the signifi cance of the brain stem in determining whether an individual is alive or dead: An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards ([1], p. 2). The plausibility of these criteria is undermined as soon as one confronts the question of the level of treatment that ought to be provided to human bodies that have permanently lost consciousness but whose brain stems are still functioning.
