Book Synopsis Reforming WTO Rules on State-Owned Enterprises by : Yingying Wu
Download or read book Reforming WTO Rules on State-Owned Enterprises written by Yingying Wu and published by Springer. This book was released on 2019-01-28 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book argues that the trade-distorting effects of advantages associated with SOEs are more severe from an economic perspective, and the behavior of SOEs after receiving advantages is of more concern, compared to private-owned enterprises (POEs). The premise is that the existence of SOEs per se is not the essential problem; rather, the underlying problems are (i) the disproportionate granting of advantages to SOEs (compared to POEs) and (ii) the behavior of SOEs once they receive advantages. The book offers a systematic analysis focusing on the various advantages granted to SOEs and their subsequent behavior. Its detailed analysis reveals the inadequacy of current WTO rules and is complemented by a number of concrete proposals.

Book Synopsis Reflections on the Antitrust Modernization Commission's Report and Recommendations Relating to the Antitrust/IP Interface by : Thomas F. Cotter
Download or read book Reflections on the Antitrust Modernization Commission's Report and Recommendations Relating to the Antitrust/IP Interface written by Thomas F. Cotter and published by . This book was released on 2014 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Antitrust Modernization Commission's (AMC's) recommendations relating to the IP/antitrust interface reflect what has become the consensus view among mainstream commentators that IP and antitrust are, for the most part, complementary rather than antagonistic bodies of law. In this article, I argue that this consensus view is largely correct, and that the AMC's consensus-based recommendations are both commendable and persuasive. In addition, however, I argue that the consensus view nevertheless fails to capture some remaining tensions that could become acute in certain ongoing disputes lying along the antitrust/IP interface. These areas of potential conflict can be grouped into three broad categories. "Category 1" comprises cases in which IP law does not provide what some market participants believe to be an adequate solution to a free-riding problem that in theory could undermine the participants' incentive to invest in innovation. When such cases arise, courts may have to determine whether self-help efforts on the part of such participants to inhabit IP's "negative space" violate IP or antitrust norms, and if so whether the two sets of norms themselves conflict. Second, and of greater significance to antitrust policy at present, joint efforts on the part of potential IP users to facilitate the adoption and use of a particular technology may give rise to antitrust problems. The report briefly discusses one recurring situation falling within this latter category ("category 2"), relating to SSOs. Third, antitrust enforcers from time to time may perceive IP law as falling far short of attaining the optimal incentives/access tradeoff. In this third category of cases ("category 3"), questions may then arise whether antitrust should come to the rescue by constraining the exercise of unduly broad IPRs. In all three categories of cases, the risk will be present that antitrust intervention may overshoot its mark, thus undermining both the incentive structures embedded within the IP laws and efforts to reform those IP laws, when necessary, from within. Problematically, it remains unclear how antitrust enforcers can weigh the procompetitive benefits of challenged conduct that substitutes for IPRs (in category 1), restricts the exercise of IPRs (category 2), or exploits those IPRs to the maximum degree (category 3), against the potential corresponding harms to the integrity of the IP incentive scheme or to social welfare generally; and yet to describe the costs and benefits as in some sense incommensurable does not make the problem go away.
Book Synopsis The EU Deep Trade Agenda by : Billy A. Melo Araujo
Download or read book The EU Deep Trade Agenda written by Billy A. Melo Araujo and published by Oxford University Press. This book was released on 2016-02-12 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: Providing the first comprehensive examination of the key regulatory disciplines included in the new generation of EU free trade agreements (FTAs), this book investigates the EU's supposed deep trade agenda through a legal analysis of these FTAs. In doing so, Billy A. Melo Araujo determines whether there is any substance behind the EU's foreign policy rhetoric regarding the need to introduce regulatory issues within the remit of international trade law. At a time when the EU is busily negotiating so-called 'mega-FTAs', such as the Transatlantic Trade and Investment Partnership (TTIP) and the plurilateral Trade in Services Agreement (TISA), Melo Araujo offers a timely insight into the important questions raised by such FTAs, in particular concerning the future of the multilateral trade system, the loss of policy autonomy, and the democratic legitimacy of regulating through treaty-making. The book provides a detailed analysis of the regulatory disciplines included in the more recent EU FTAs and explores the possible implications of such disciplines. Offering a significant contribution to a wider debate, this is a must read for those interested in the legal dimension of the EU's deep trade agenda.

Book Synopsis The Microsoft Antitrust Cases by : Andrew I. Gavil
Download or read book The Microsoft Antitrust Cases written by Andrew I. Gavil and published by MIT Press. This book was released on 2014-11-28 with total page 461 pages. Available in PDF, EPUB and Kindle. Book excerpt: A comprehensive account of the decades-long, multiple antitrust actions against Microsoft and an assessment of the effectiveness of antitrust law in the digital age. For more than two decades, the U.S. Department of Justice, various states, the European Commission, and many private litigants pursued antitrust actions against the tech giant Microsoft. In investigating and prosecuting Microsoft, federal and state prosecutors were playing their traditional role of reining in a corporate power intent on eliminating competition. Seen from another perspective, however, the government's prosecution of Microsoft—in which it deployed the century-old Sherman Antitrust Act in the volatile and evolving global business environment of the digital era—was unprecedented. In this book, two experts on competition policy offer a comprehensive account of the multiple antitrust actions against Microsoft—from beginning to end—and an assessment of the effectiveness of antitrust law in the twenty-first century. Gavil and First describe in detail the cases that the Department of Justice and the states initiated in 1998, accusing Microsoft of obstructing browser competition and perpetuating its Windows monopoly. They cover the private litigation that followed, and the European Commission cases decided in 2004 and 2009. They also consider broader issues of competition policy in the age of globalization, addressing the adequacy of today's antitrust laws, their enforcement by multiple parties around the world, and the difficulty of obtaining effective remedies—all lessons learned from the Microsoft cases.
Book Synopsis How the Chicago School Overshot the Mark by : Robert Pitofsky
Download or read book How the Chicago School Overshot the Mark written by Robert Pitofsky and published by Oxford University Press. This book was released on 2008-10-14 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: How the Chicago School Overshot the Mark is about the rise and recent fall of American antitrust. It is a collection of 15 essays, almost all expressing a deep concern that conservative economic analysis is leading judges and enforcement officials toward an approach that will ultimately harm consumer welfare. For the past 40 years or so, U.S. antitrust has been dominated intellectually by an unusually conservative style of economic analysis. Its advocates, often referred to as "The Chicago School," argue that the free market (better than any unelected band of regulators) can do a better job of achieving efficiency and encouraging innovation than intrusive regulation. The cutting edge of Chicago School doctrine originated in academia and was popularized in books by brilliant and innovative law professors like Robert Bork and Richard Posner. Oddly, a response to that kind of conservative doctrine may be put together through collections of scores of articles but until now cannot be found in any one book. This collection of essays is designed in part to remedy that situation. The chapters in this book were written by academics, former law enforcers, private sector defense lawyers, Republicans and Democrats, representatives of the left, right and center. Virtually all agree that antitrust enforcement today is better as a result of conservative analysis, but virtually all also agree that there have been examples of extreme interpretations and misinterpretations of conservative economic theory that have led American antitrust in the wrong direction. The problem is not with conservative economic analysis but with those portions of that analysis that have "overshot the mark" producing an enforcement approach that is exceptionally generous to the private sector. If the scores of practices that traditionally have been regarded as anticompetitive are ignored, or not subjected to vigorous enforcement, prices will be higher, quality of products lower, and innovation diminished. In the end consumers will pay.

This book was released on 1967 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report of the President's Commission on Law Enforcement and Administration of Justice -- established by President Lyndon Johnson on July 23, 1965 -- addresses the causes of crime and delinquency and recommends how to prevent crime and delinquency and improve law enforcement and the administration of criminal justice. In developing its findings and recommendations, the Commission held three national conferences, conducted five national surveys, held hundreds of meetings, and interviewed tens of thousands of individuals. Separate chapters of this report discuss crime in America, juvenile delinquency, the police, the courts, corrections, organized crime, narcotics and drug abuse, drunkenness offenses, gun control, science and technology, and research as an instrument for reform. Significant data were generated by the Commission's National Survey of Criminal Victims, the first of its kind conducted on such a scope. The survey found that not only do Americans experience far more crime than they report to the police, but they talk about crime and the reports of crime engender such fear among citizens that the basic quality of life of many Americans has eroded. The core conclusion of the Commission, however, is that a significant reduction in crime can be achieved if the Commission's recommendations (some 200) are implemented. The recommendations call for a cooperative attack on crime by the Federal Government, the States, the counties, the cities, civic organizations, religious institutions, business groups, and individual citizens. They propose basic changes in the operations of police, schools, prosecutors, employment agencies, defenders, social workers, prisons, housing authorities, and probation and parole officers.
